at various times throughout the meeting, all final actions within a given topic
are combined in these minutes for convenience of reference.]
Friday, June 20
The meeting was called to
order at 9:30 a.m. by the chair, Ms. Rittgers. All members were present as noted above.
1.
Introductions and Updates. Ms.
Rittgers welcomed guests Dr. Green, Mr. Uryasz and Ms. Wickerham, and new
member, Laurie Turner, to the meeting.
2.
Previous Minutes.
It was VOTED
"That the minutes of the December 15, 2002, subcommittee meeting
be approved with a minor edit."
3.
Governance Reports. The subcommittee
reviewed the progress of its recommendations to the NCAA Division I
Championships/Competition Cabinet and the NCAA Divisions II and III Management
Councils. The subcommittee noted
the mixed approval to move forward on an all-sport drug-testing plan and will
present further justification to the Cabinet for this recommendation. The subcommittee also noted that
discussions regarding drug-testing sanctions will continue through the
sanctions group, which will bring a proposal to the winter NCAA Committee on
Competitive Safeguards and Medical Aspects of Sports (CSMAS) meeting.

Banned Substance List. The subcommittee recommended amplifying the banned drug
list to identify by name phenylephrine and synephrine (bitter orange, citrus
aurantium, zhi shi), substances that are banned under related compounds in the
stimulant category, and which are included in some of the “ephedra-free”
products.
5.
Drug-Testing Protocol. The
subcommittee approved wording modifications to the protocol, clarifying that a
student-athlete with continuing NCAA eligibility can be drug tested by the NCAA
through June of the year the consent form was signed, even if the school drops
the student-athlete’s sport. The
subcommittee also approved the placement in the NCAA Drug-Testing Program book
of a stronger statement warning of the risks of nutritional supplements. In addition, the subcommittee
recommended removing the comment part by the surrogate on the “B” results form
at the opening of the B sample at the lab.
6.
Appeal Process and Medical Exception Process. The subcommittee confirmed its understanding that a quorum
must include three professional staff, that the Student-Athlete Advisory
Committee (SAAC) member has full voting rights and that a majority vote is sufficient
for an appeal determination. The
subcommittee approved changes in the medical exceptions language to address the
use of medications that include banned substances for which there is no current
drug test, e.g. peptide hormones.
The National Center for Drug Free Sport (Drug Free Sport) will draft the
language to be included in the protocol.
The subcommittee confirmed its understanding that the NCAA is not
required to disclose information about prior appeals outcomes because the
appeal is an administrative procedure.
7.
Drug-Testing Consent Form. No
report.
8.
Student-Athlete Statement. The subcommittee drafted an
additional clarification regarding the reporting of a prior positive drug test
from a national or international athletics organization to be added to the
student-athlete statement.
9.
Drug Testing Issues.
a.
Drug-Testing Issues Update. The
subcommittee received a presentation from Dr. Green on the latest issues in
testing for performance enhancing substances, including information about
stimulant substances that are replacing ephedra in energy and weight loss
products and new testing for erythropoietin (EPO), which is beginning to be
included in the NCAA championships testing.
b.
Outside Sanctions and Graded Penalties. Members of the subcommittee will meet to draft a proposal to
address outside sanctions and the NCAA penalty structure, and present the
proposal to the full committee (CSMAS) for approval at the winter meeting. This group will also consider how to
advise member institutions about what issues are considered mitigating and what
is the rationale for granting an appeal.
c.
Competition While Under Drug-Test Sanctions. The subcommittee requested that staff obtain clarification
from the student-athlete reinstatement staff about the implications for
reinstatement if a student-athlete competes in an open meet while under an NCAA
drug-test sanction.
d.
Drug-Testing Program Evaluation. The
subcommittee reviewed an amended evaluation form. Ms. Wickerham will begin administering evaluations with the
upcoming drug-testing season.
e.
Drug-Test Expansion. The subcommittee
recommended adoption of an all-sport drug-testing plan for Divisions I and II
in the year-round program, identifying it as its top priority in the upcoming
biennial budget request process. Details of the plan were presented by Mr. Uryasz and included
maintaining current testing levels in Divisions I and II football, and testing
four additional randomly selected players in a rotational selection of all
other sports.
f.
Testing Products for Contamination.
The subcommittee received information presented by Drug Free Sport that
there currently exists no practical means of confidently testing supplements
for contamination.
g.
Specimen Ownership. The subcommittee
reiterated that samples collected through the NCAA drug-testing program remain
the property of the NCAA. It
affirmed that the current lab practice is ethical and fair with confirmation
and opportunity to assure chain of custody. The subcommittee agreed that if, during an appeal, testimony
raises significant doubt for the appeal panel, the panel can consider
permitting a second outside testing of the sample.
h.
Institutional Responsibility To Accommodate Year-Round Drug-Testing. The subcommittee recommended an amendment to NCAA
legislation to clearly define institutional responsibility to accommodate NCAA
drug testing and to provide a penalty when this responsibility is not met.
10.
Drug Testing Results. The
subcommittee voted to accept the August 2002 – July 2003 drug-testing results.

11.
Alcohol Education Programs.
a.
APPLE. The subcommittee received a
presentation from Ms. Allen-Hawkins, health educator from the Center for
Substance Abuse Education (CASE), the department that conducts the two annual
APPLE conferences.
b.
Techniques for Effective Alcohol Management (TEAM). The subcommittee received an update on TEAM, an organization
that trains stadium personnel to manage crowd issues involving alcohol
use. TEAM participated in the
February NCAA-hosted Sportsmanship and Fan Behavior Summit in Dallas. TEAM will be hosting a training at the
Ohio State University this month.
c.
CHOICES Grant. The subcommittee
considered a staff proposal to commission an evaluation of the CHOICES program,
which would be absorbed within the current drug-education budget. It also considered the priority for its
support, identified at the December 2002 meeting, to expand the CHOICES awards
to 10-15 annually. This issue will
be measured against other priorities arising from the full committee's
recommendations for funding new initiatives and expansions through the biennial
NCAA
budget process.
d. Betty
Ford Center Professional-in-Residence (PIR). Ms. Rittgers shared observations of her
Professional-in-Residence experience.
The subcommittee reviewed the evaluations from the other PIR attendees
and agreed to pilot a five-day program with the next year’s PIR group.
e. Speakers
Grant. The subcommittee will
consider expanding the NCAA Speakers Grant program to address issues beyond the
four areas it currently covers, which are alcohol, tobacco and other drug abuse
prevention/addictions; nutrition; sexual health, including homophobia issues;
and stress reduction.
12.
Tobacco Issues. The subcommittee
reviewed the budget implication of the umpires’ survey, developed by Drug Free
Sport, regarding the NCAA tobacco ban.
Efforts to gain outside funding have not been successful. Funding of this project is pending the
final review of the drug-education budget.
13. Nutritional Supplements. The subcommittee recommended adoption
of consistent language across the divisions defining nutritional supplements as
permissible benefits. The subcommittee
proposed that Division I language legislative in 16.5.2.g be adopted in
Divisions II and III. The
subcommittee also reviewed and amended the nutritional supplement review form,
and recommended placing the form on the NCAA Web site as an optional resource,
but not mailing out to the membership.
14. Drug Education Budget. The subcommittee reviewed and
reallocated unspent funds in the drug-education budget, agreeing to use funds
towards the baseball umpires survey, the Triad Summit and the CHOICES program
evaluation.
15. Surveys. The subcommittee reviewed and edited the NCAA biennial
Drug-Education and Testing Survey for administration in September 2003 and the
quadrennial Drug-Use Survey for administration in September 2004.
16. Banned Drug Wallet Cards. The subcommittee gave approval for Drug
Free Sport to continue to print and disseminate the new banned drug wallet
cards with the upcoming season’s championships schedule
17. Adjournment. The meeting adjourned at noon.
