SUMMARY OF THE NCAA DIVISION I BOARD OF DIRECTORS
AUGUST 2006 ACTIONS
RELEVANT TO THE
NCAA DIVISION I ACADEMICS/ELIGIBILITY/COMPLIANCE CABINET
1. NCAA President's Report.
Received a report from the NCAA president in which he discussed the following:
a. Update on the Presidential Task Force on the Future of Division I Intercollegiate Athletics. The final report of the Presidential Task Force on the Future of Division I Intercollegiate Athletics, which will be published in late October, will focus on two broad themes: presidential leadership and fiscal responsibility. Specifically, the report will reference the importance of presidential leadership not just at the national level but at the local level and will seek to provide presidents with appropriate financial information that can serve as a helpful management tool.
b. Summer Basketball Issues. Over
the past few years the NCAA has brought together some key stakeholders in the
sport of men's basketball to discus the health and future growth of that
sport. Through those discussions it has become clear that many view the
culture associated with youth basketball as the biggest threat to the game.
Accordingly, the NCAA has joined forces with the National Basketball Association
to co-sponsor a summit scheduled for this fall to continue to examine and
address this important issue.
c. Involvement of Student-Athletes in Institutional, Charitable, Educational or Nonprofit Promotions. Issues surrounding the proper level of involvement of student-athletes in institutional, charitable, educational and nonprofit activities are both controversial and complex. The current bylaws regulating such activities have arguably not kept up with technology. Therefore, to help address these difficult and emotional issues and ensure there is an appropriate level of membership expertise involved in the discussions, the NCAA Division I Academic/Eligibility/Compliance Cabinet Subcommittee on Agents and Amateurism has been charged with seeking to the develop recommendations which will ultimately be reviewed by the Division I membership. To ensure that this review is thorough and the recommendations well thought out, it is speculated the process may take as long as a year.
2. NCAA Division I Committee on Academic Performance. An update relating to the Committee on Academic Performance will be provided separately during the cabinet meeting.
3. Update on Efforts to Address Improprieties and Irregularities in Secondary Schools.
Received an
update on the progress made since the NCAA Division I Board of
Directors's action at its April 27 meeting,
intended to address improprieties and irregularities in secondary schools and
learned that:
a. As a result of the ongoing high school review process, to date, it has been determined that 25 high schools will not be used in the initial-eligibility process;
b. As this effort continues, reviews will also be conducted of individual student-athlete records to identify potential irregularities; and
c. There is legislation in the Division I 2006-07 cycle, which is intended to help limit the potential for abuse by providing that a prospective student-athlete must complete his or her core-curriculum requirements not later than the high school graduation date of the prospect's class; however, if the prospect graduated from high school within the core-curriculum time limitation, he or she may use one core course completed in the year following graduation, but not later than the end of the academic year immediately following the high school graduation date of the prospect's class.
4. Update on Developments with the
NCAA Amateurism Certification ProcessClearinghouse.
Received an update on plans for the NCAA NCAA Amateurism
Certification
Processlearinghouse, which will be charged
with certifying all international and domestic prospective and transfer
student-athletes prior to initial participation at Division I or II member
institutions and were informed of the following:
a. That agreement has been reached between the NCAA and ACT for ACT to operate the amateurism portion of the NCAA Initial-Eligibility Clearinghouse as part of its overall operations;
b.
The NCAA Amateurism Certification ProcessClearinghouse
is scheduled to open on November 20 and will provide certification decisions
for student-athletes enrolling fall 2007.;
5. Legislative and Governance Issues.
a. Request to take emergency action.
· NCAA Proposal No. 2006-15 Committees -- Division I Cabinets And Committees -- Academics/Eligibility/ Compliance Cabinet -- Amateurism Fact-Finding
·Committee. Intent: To
establish the NCAA Division I Amateurism Fact-Finding Committee, which will
make a determination of facts related to the certification of the amateur
status of a prospective student-athlete in cases in which an institution does
not agree with the determination of facts rendered by the initial-eligibility clearinghouse.
Adopted the proposal as emergency legislation. (Effective Date: Immediate.)
b. Override Request on Proposal Nos. 2005-54 and 2005-128.
(1) Proposal No. 2005-54 -- Eligibility -- Graduate Student or Postbaccalaureate Participation -- Transfer Eligibility. Intent: To permit a student-athlete who is enrolled in a specific graduate degree program of an institution other than the institution from which he or she previously received a baccalaureate degree to participate in intercollegiate athletics regardless of any previous transfer. (a) Were informed that 45 member institutions submitted requests to override the Board of Directors' adoption at its April 27 meeting of Proposal No. 2005-54, and discussed the proposal at length;
(b) Defeated a motion to reconsider the Board's previous adoption of Proposal No. 2005-54. Accordingly a vote of the active Division I membership will occur at the Division I business session at the 2007 NCAA Convention.
(c) Requested that the Board receive periodic updates regarding the impact of this legislation.
[Note: At least a 5/8 majority vote of individual active members present including conference members in the governance structure and voting shall be required to override the legislative action taken by the Board of Directors. The vote shall be based on the principal of one institution, one vote and the vote shall be taken by roll call.]
c. Discussion regarding timing of governance meetings.
(1) Received a brief update on the ongoing work of the NCAA Division I Management Council's Governance Subcommittee as it seeks to enhance the level of information and communication that is shared with the Board from the governance substructure; and
(2) Were informed that the Board can expect to receive information during the fall regarding legislative issues of interest in an effort to better assist the Board in preparing for the possible consideration of select legislative proposals at its January meeting.
6. Update on Efforts to Address Labeling Issues for Division I-A, I-AA and I-AAA.
Agreed to:
a. Delete the labels Division I-A, I-AA
and I-AAA from NCAA use, effective
December 22, 2006.
b. Adopt the title "NCAA Division I
Football Championship" to replace the "Division
I-AA Football Championship," the current title.
c. Adopt the terms "Football Bowl Subdivision" and "NCAA Football Championship Subdivision" to refer to the level of football played by Division I members.
7. Information Regarding the Establishment of the Baseball Academic Enhancement Working Group.
a. Received a report on the establishment of the Baseball Academic Enhancement Working Group along with a preview of that group's August 4 meeting; and
b. Learned that as that group seeks to address its charge of developing recommendations by April 2007 aimed at improving the academic performance of baseball student-athletes, it plans to examine such factors as:
(1) Academic performance of two-year college transfers (eligibility).
(2) Academic profile of incoming baseball prospects (eligibility).
(3) Pre- and post-game time commitment of student-athletes (eligibility).
(4) Maximum number of contests/schedule compaction (eligibility).
(5) 20-hour rule (eligibility).
(6) Missed class time (eligibility).
(7) In-seasons versus out-of-season academic performance (eligibility).
(8) Maximum of 11.7 financial aid equivalencies (financial aid).
(9) Equivalency vs. head count financial aid (financial aid).
(10)
Comparison of academic performance of (non-) fully funded programs.
(financial aid).
(11) The one-time transfer exception (retention).
