Intent: To specify that for a four year period beginning August 9, 2007, no institution may begin the Division I provisional or reclassification membership process (including the exploratory process), no institution may begin the multidivisional membership reclassification process and no new single sport or multisport conference shall be elected to Division I conference membership.

3.1 ELIGIBILITY FOR MEMBERSHIP

 

3.1.1 General. Membership is available to colleges, universities, athletics conferences or associations and other groups that are related to intercollegiate athletics; that have acceptable academic standards (as defined in Constitution 3.2.3.2), and that are located in the United States, its territories or possessions. Such institutions or organizations must accept and observe the principles set forth in the constitution and bylaws of the Association.  For a four year period beginning August 9, 2007, no institution may begin the Division I provisional or reclassification membership process (including the exploratory process), no institution may begin the multidivisional membership reclassification process and no new single sport or multisport conference shall be elected to Division I conference membership.

20.5.1 Reclassification Options. A member institution may request a change of division membership according to the provisions of this section. A member of Division I may petition to change its membership to Division II or Division III, and a member of Division II may petition to change its membership to either Division I or Division III.  (See Constitution 3.1.1.)

Rationale:  In 2000, the membership approved a moratorium to allow each division an appropriate time period to address issues related membership growth.  During that two-year time period, Division I established a more detailed educational assessment program to govern the transition to Division I and developed standards that more clearly distinguish football playing institutions among subdivisions.  While the membership transition processes have improved, the simple fact is that migration to Division I continues and shows no sign of slowing down.  In addition, there has been proliferation of new conferences, including single sport conferences, which can and has resulted in a change in the format and conduct of NCAA championships.  It is both prudent and reasonable to take time to assess and study the impact of these changes and develop reasonable philosophical expectations and legislative requirements that should be adhered to by all institutions desiring to transition to or remain in Division I.  An Executive Committee working group is currently reviewing Association-wide membership issues, particularly those impacting Divisions II and III, and recommendations are likely to be developed in the near future.  It is difficult to project the implications of such recommendations on the Division I membership.  Further, Division I is undertaking a potential change in its governance structure.  With that in mind, it is likely that it will take some time to establish a framework to address membership issues, analyze the current philosophies, expectations and requirements and introduce and begin to implement proposed changes.  A four-year period should provide a reasonable amount of time to accomplish this initiative.

PROPOSAL NO. 2007-9 – FINANCIAL AID AND PLAYING AND PRACTICE SEASONS -- MAXIMUM INSTITUTIONAL GRANT-IN-AID LIMITATIONS BY SPORT -- SQUAD SIZE LIMITATION – BASEBALL (as amended)

Status: Adopted, 60-Day Override Period  

 

Intent: To specify that: (a) there shall be an annual limit of 11.7 on the value of financial aid awards (equivalencies) to counters and an annual limit of 27 (30 in 2008-09) on the total number of counters in baseball at each institution; (b) an institution shall provide each counter athletically related and other countable financial aid that is equal to or greater than 25 percent of an equivalency; and (c) an institution shall declare, by the day prior to its first scheduled contest in the championship segment of the playing and practice season, a squad of a maximum of 35 student-athletes who shall be eligible to participate in countable athletically related activities during the remainder of the championship segment.

15.5.4.1 Minimum Equivalency Value.  An institution shall provide each counter athletically related and other countable financial aid that is equal to or greater than 25 percent of an equivalency.

Rationale: The average number of baseball student-athletes receiving athletics aid among Division I baseball programs is 27, however, there are some programs that annually exceed as many as 40 baseball student-athletes receiving some portion of aid. A minimum award of athletically related and other countable financial aid at 25% of an equivalency ensures an appropriate balance between addressing student-athlete well-being for those reluctant to serve a year of transfer residence and the ability of baseball coaches to effectively and efficiently manage distribution of 11.7 equivalencies. Requiring the 25% minimum helps ensure the baseball program is truly committed to the student-athlete, thereby encouraging more responsible recruiting and making it less likely for coaches to facilitate transfers of student-athletes to whom they are significantly committed financially. Coaches will be less likely to employ a "run-off" strategy of squad size maintenance after having what amounts to a fall term tryout if the number of counters is limited at the outset. Encouraging a student-athlete who is one of 27 counters to transfer during the academic year will not only cost that institution NCAA Division I Academic Progress Rate points, but the institution will not be able to replace that student-athlete with another counter.

Intent: To specify that all NCAA championships shall be conducted in accordance with the general policies established by the Championships/Competition Cabinet, Management Council, Board of Directors and/or the Executive Committee.

Bylaws:  Amend 31.1, as follows:

31.1 ADMINISTRATION OF NCAA CHAMPIONSHIPS

31.1.1 Authority of Championships/Competition Cabinet, Management Council, Board of Directors and/or Executive Committee and Sports Committees.  As specified in Bylaw 18.1, all NCAA championships shall be conducted in accordance with the general policies established by the Championships/Competition Cabinet, Management Council, Board of Directors and/or Executive Committee and shall be under the control, direction and supervision of the appropriate sports committees, subject to the standards and conditions set forth in these executive regulations.  Additional policies of an administrative nature are set forth in the respective championships handbooks and are to be followed in the administration of NCAA championships.

Rationale:   The NCAA structure and applicable bylaws give authority over championship-related issues to several committees or cabinets.  The NCAA structure and Constitution also assign the Executive Committee responsibility over Association-wide matters, including championship-related issues.  The Executive Committee has authority to adopt and implement policies governing NCAA championships.  This amendment neither changes the duties and responsibilities of the Executive Committee nor does it expand its authority or power.  Instead, this amendment simply clarifies existing authority by stating expressly that NCAA championships be conducted in accordance with policies of the Management Council, Board of Directors and/or Executive Committee.
