Rationale: In 2000, the membership approved a moratorium to allow each division an appropriate time period to address issues related membership growth. During that two-year time period, Division I established a more detailed educational assessment program to govern the transition to Division I and developed standards that more clearly distinguish football playing institutions among subdivisions. While the membership transition processes have improved, the simple fact is that migration to Division I continues and shows no sign of slowing down. In addition, there has been proliferation of new conferences, including single sport conferences, which can and has resulted in a change in the format and conduct of NCAA championships. It is both prudent and reasonable to take time to assess and study the impact of these changes and develop reasonable philosophical expectations and legislative requirements that should be adhered to by all institutions desiring to transition to or remain in Division I. An Executive Committee working group is currently reviewing Association-wide membership issues, particularly those impacting Divisions II and III, and recommendations are likely to be developed in the near future. It is difficult to project the implications of such recommendations on the Division I membership. Further, Division I is undertaking a potential change in its governance structure. With that in mind, it is likely that it will take some time to establish a framework to address membership issues, analyze the current philosophies, expectations and requirements and introduce and begin to implement proposed changes. A four-year period should provide a reasonable amount of time to accomplish this initiative.

Rationale: The average number of baseball student-athletes receiving athletics aid among Division I baseball programs is 27, however, there are some programs that annually exceed as many as 40 baseball student-athletes receiving some portion of aid. A minimum award of athletically related and other countable financial aid at 25% of an equivalency ensures an appropriate balance between addressing student-athlete well-being for those reluctant to serve a year of transfer residence and the ability of baseball coaches to effectively and efficiently manage distribution of 11.7 equivalencies. Requiring the 25% minimum helps ensure the baseball program is truly committed to the student-athlete, thereby encouraging more responsible recruiting and making it less likely for coaches to facilitate transfers of student-athletes to whom they are significantly committed financially. Coaches will be less likely to employ a "run-off" strategy of squad size maintenance after having what amounts to a fall term tryout if the number of counters is limited at the outset. Encouraging a student-athlete who is one of 27 counters to transfer during the academic year will not only cost that institution NCAA Division I Academic Progress Rate points, but the institution will not be able to replace that student-athlete with another counter.

Rationale: The NCAA structure and applicable bylaws give authority over championship-related issues to several committees or cabinets. The NCAA structure and Constitution also assign the Executive Committee responsibility over Association-wide matters, including championship-related issues. The Executive Committee has authority to adopt and implement policies governing NCAA championships. This amendment neither changes the duties and responsibilities of the Executive Committee nor does it expand its authority or power. Instead, this amendment simply clarifies existing authority by stating expressly that NCAA championships be conducted in accordance with policies of the Management Council, Board of Directors and/or Executive Committee.
