Process for the Division I Board of
Directors to consider Legislation in January
In November, the Division I
Management Council Legislative Review Subcommittee (LRS) reviewed all
legislative proposals in the 2007-08 cycle to assist the Management Council as
it readies for its initial review of legislation in January. As part of its charge, LRS recommends whether proposals should
receive support to move straight to the Board of Directors for adoption in
January; be defeated, or be sent out for comment and further consideration in
April.
This year, of the 104 legislative proposals in the cycle, the LRS is recommending that 46 proposals receive the requisite two-thirds support to move straight to the Board of Directors in January for adoption (categories a. and b.), that another 40 proposals be defeated (category c.) and that the remaining proposals be sent out for membership comment (category d.). The report that follows is organized into these four categories:
a. Proposals recommended to go straight to the Board by virtue of being considered as part of the Management Council’s consent package.
b. Proposals recommended to go straight to the Board for consideration.
c. Proposals recommended for defeat.
d. Proposals to be forwarded to the membership for further review and comment.
Prior to the Board’s January meeting, we encourage you to review those proposals that are being recommended for immediate adoption to ensure that you are comfortable voting to approve this legislation. We will communicate this same information to your conference office in order to ensure that you are advised of any conference concerns. We expect that many, if not all, of these proposals will be presented to you in January for adoption.
It
also is likely that some additional proposals will receive two-thirds support,
which will result in Board consideration in January as well. We will make sure that you are apprised
of this grouping.

To specify that a prospective student-athlete may receive educational expenses or services related to tutoring and standardized test preparatory classes from any individual or entity other than an agent, professional sports teams/organization or a representative of an institution's athletics interests, provided such expenses are disbursed directly to the individual, organization, or educational institution providing the educational service. |

To specify that for violations of the preferential treatment legislation in which the value of the benefit is $100 or less, the eligibility of the individual shall not be affected, conditioned on the individual repaying the value of the benefit to a charity of his or her choice; further, to specify that the individual shall remain ineligible from the time the institution has knowledge of receipt of the impermissible benefit until the individual repays the benefit. |
