The NCAA Division I Legislative Review/Interpretations Committee telephone conference was called to order at 3 p.m. by the acting chair, Ms. Shoemake.  All members were present as noted above.

 

 

Recruiting -Evaluations

 

1.      Evaluations of Individuals Prior to Ninth Grade.  (I) The committee recommends that the NCAA Division I Management Council modify a previous council-approved official interpretation  [Reference:  07/18/2001, Item No. 2] to specify that evaluation activities


related to individuals who are not yet prospective student-athletes may only occur during contact or evaluation periods when it is permissible to evaluate prospective student-athletes. [References: NCAA Bylaws 13.02.11 (prospective student-athlete), 13.02.4 (recruiting periods) and 13.1.8 (limitations on number of evaluations-all sports).]

 

 

Recruiting – Practice Activities Prior to Enrollment

 

2.   Practice Activities with a Prospective Student-Athlete Prior to Enrollment and Outside of the Playing Season.  (I)  The committee confirmed that it is not permissible for an institution's coaching staff members to engage in any practice activities (e.g., review of playbook, chalk talk, film review) with a prospective student-athlete prior to his or her initial enrollment at the certifying institution and outside of the institution's playing season.  [References: Bylaws 14.1.8.1 (requirement for practice), 14.1.8.1.1 (practice prior to initial enrollment), 17.02.1 (countable athletically related activities) and 17.1.1 (playing season).]

Personnel -- Recruiting – Recruiting Services or Publications

 

1.         Interview of Athletics Department Staff Members by Media Outlets Associated with a Recruiting Service or Publication.  The committee determined that it is permissible for an athletics staff member to provide an interview for a noninstitutional publication or other media outlet that is associated with an entity that also includes a recruiting service or publication, provided the individual conducting the interview is not involved with the recruiting service or publication division of the entity and information from the interview is not included in any media (e.g., publication, Web page, television or radio program) that is primarily devoted to reporting on the athletics participation or evaluation of prospective student-athletes.  The committee noted that in the case of a Web site, this standard is applied to each separate page within the overall site. [Note: This interpretation clarifies a previous official interpretation (reference:  2/2/06, Item No. 1), which has been archived].  [References: NCAA Bylaw 11.3.2.4 (noninstitutional publications that report on athletics program); Bylaw 11.3.2.4.1 (educational materials); Bylaw 11.3.2.5 (recruiting service consultants); Bylaw 13.4.4.1 (recruiting advertisement); and Bylaw 13.4.4.1.2 (interview to recruiting publication).]

1.         Providing Necessary Preenrollment Information to Prospective Student-Athletes.  (I)  The committee determined that any necessary preenrollment information, including information in a video format, regarding orientation, conditioning, academics and


            practice activities may be provided to a prospective student-athlete, provided the prospect has signed a National Letter of Intent or financial aid agreement or has been officially accepted for enrollment.  [Reference: NCAA Bylaw 13.4.1.1 (printed recruiting materials).]

 

 

Recruiting – Tryout Events – Host Institution

           

2.         National Team Tryout Events on an Institution's Campus.  (I)  The committee confirmed that it is permissible for an institution to host national team tryout events conducted by the applicable national governing body.  [References: Bylaw 13.11.1.5 (tryout events) and NCAA Proposal No. 2005-155.]

Prize Money Prior To Full-Time Collegiate

Enrollment – Coaching and Instruction as Actual and Necessary Expenses

 

1.      Prize Money Prior to Initial Full-Time Collegiate Enrollment and Coach’s Expenses or Fees.  The committee determined that for the purpose of calculating a prospective student-athlete's actual and necessary expenses related to participation in an open athletics event, the calculation may not include the expenses or fees of anyone other than the prospective student-athlete (e.g., coach's fee or expenses, parent's expenses).  [Reference: NCAA Bylaw 12.1.1.4.1 (exception for prize money prior to full-time collegiate enrollment).]

 

     

Amateurism – Student-Athlete Establishing His or Her Own Business

           

2.   Student-Athlete Establishing His or Her Own Business. The committee determined that a student-athlete may establish his or her own business, provided the student-athlete’s name, photograph, appearance or athletics reputation are not used in any manner to promote such a business.[lz1]  [References: Bylaws 12.4.1.1 (athletics reputation), 12.5.2.1 (advertisements and promotions subsequent to enrollment), a 2/4/81 official interpretation, Item o and a 2/13/91 staff interpretation, Item b, which has been archived.]

2.      Timing of Foreign Tour.  The committee confirmed that an institution may not engage in a


foreign tour during the period beginning 30 days prior to the first permissible practice date until the institution’s first scheduled contest or date of competition, as opposed to the first permissible date for a contest or date of competition.  [Reference: NCAA Division I Bylaw 30.7.8 (Timing of Tour)]

Recruiting/Contact Restrictions at Specified Sites

 

1.      Electronic Correspondence while a Prospect is at the Site of Competition.  The committee determined that an institution’s coaching staff member may not send electronic correspondence (e.g., text or instant messages, e-mail) to a prospect while he or she is on call for competition at the site of the competition (e.g., arena, stadium).  Electronic correspondence may be sent to the prospect while the prospect is on call and not at the site of competition or while the prospect is at any location once he or she has been released by the


appropriate authority.  The committee noted that in men’s and women’s basketball, additional restrictions preclude communication with prospects during summer certified events and the July evaluation periods, respectively.  [lz1]The committee doesn't archive interps.  That is a natural result of new interpretations.  Although Steve may disagree, I think LRIC can issue a new interp and still be consistent with the 2/4/81 interp I added below.  I would argue that interp only precludes a student-athlete from establishing his or her own business when his or her name, photograph or appearance are used.  The staff took it a step further to say that the use of a name, photograph or reputation to promote the business is inherent in establishing a business.  Otherwise, LRIC would have to ask the Management Council to modify the 2/4/81 interp.
