WHAT TO EXPECT WITH REGARD TO

PROPOSAL NOS. 2005- 54 and 2005-128.

 

 

1.      Override Requests on Proposal Nos. 2005-54 and 2005-128.

 

45 Division I member institutions submitted requests to override the Board of Directors action in adopting Proposal No. 2005-54.  This proposal, which had an immediate effective date, permits a student-athlete who is enrolled in a specific graduate degree program of an institution other than the institution from which he or she previously received a baccalaureate degree to participate in intercollegiate athletics regardless of any previous transfer.

 

Further, 32 Division I-AA member institutions submitted override requests with regard to Proposal No. 2005-128, which was defeated by the I-AA members of the Board of Directors.  This proposal, if it had been adopted, would in Division I-AA football, have permitted an institution to compete annually in 12 regular-season contests.  

 

 

2.      What do these override requests mean?

 

Pursuant to NCAA Bylaw 5.3.2.3.2 upon receipt of at least 30 override requests, the Board of Directors is asked to review its earlier legislative decisions.  (Note:  In the case of a Division I-AA issue, such as the one set forth in Proposal No. 2005-128, Bylaw 5.3.2.3.1.1 sets the threshold at a minimum of 15 override requests rather than 30 in order for the Board to review its earlier legislative decision.)

 

 

3.      August Division I Board of Directors Meeting.

 

At its August meeting, the Board of Directors discussed Proposal No. 2005-54 at length and defeated a motion to reconsider its previous adoption of the proposal.  Accordingly, a vote of the active Division I membership will occur on January 6, 2007, during the Division I Business Session at the 2007 NCAA Convention. 

 

The Board also discussed Proposal No. 2005-128 but supported a motion to defer considering the override request on the proposal given the Division I-AA/I-AAA Presidential Advisory Group’s request to have an opportunity to further discuss this matter at its next meeting on October 25, 2006.    

 

 

 

 

4.      Possible Outcomes in October regarding Proposal No. 2005-128.

 

At its October meeting, the Division I-AA members of the Board may:

 

a.      Accept the override requests by changing its original action and adopt Proposal No. 2005-128.  If the Board would accept the override request, and adopt the proposal, the Board's action would be subject to another 60-day override period.    

 

b.      Uphold its earlier decision to defeat Proposal No. 2005-128.  If the Board upholds its earlier action to defeat the proposal, a vote of active Division I-AA members would also take place at the Division I Business Session at the 2007 NCAA Convention.  

 

c.      Develop alternative approach.  Given the nature of the proposal being reviewed, the possibility of identifying an alternative approach does not appear likely.  Any alternative approach adopted by the Board would again enter into an override period.

 

 

5.      2007 NCAA Convention.

 

Given that the Division I Board of Directors upheld its earlier decision on Proposal No. 2005-54, the issue will be considered by the membership at the 2007 NCAA Convention.  This vote will occur during the Division I Business Session scheduled for the afternoon of January 6, 2007, directly after the Division I Legislative Forum.  (Note:  If the Division I-AA members of the Board uphold their earlier decision regarding the defeat of Proposal No. 2005-128, this override request will also be considered at the 2007 Convention under the same procedure, with the only exception being the consideration will be limited to Division I-AA members.)        

 

At least a five-eighths majority vote of individual active members present including conference members in the governance structure and voting shall be required to override the legislative action taken by the Board of Directors (Division I-AA members in the case of Proposal No. 2005-128).  The vote shall be based on the principle of one institution, one vote and the vote shall be taken by roll call.

 

An override of the Board's legislative action by vote of the membership shall be effective upon adjournment of the voting session in which the vote occurs.
