PROPOSAL NO. 2006-100 – COMMITTEES -- DIVISION I PRESIDENTIAL ADVISORY GROUP -- DUTIES AND AUTHORITY -- NCAA FOOTBALL CHAMPIONSHIP SUBDIVISION LEGISLATION

Status: Board of Directors Consideration  


Intent: To specify that members of the Division I Presidential Advisory Group who represent NCAA football championship subdivision conferences shall have the authority to act on behalf of the football championship subdivision members of the Board of Directors on legislative issues specific to championship subdivision football.


Bylaws: Amend 21.7.8.1.3, as follows:

"21.7.8.1.3 Duties. The Division I Presidential Advisory Group shall advise and provide input to the seven members of the committee who serve on the Board of Directors.  In addition, members of the Division I Presidential Advisory Group who represent football championship subdivision conferences shall have the authority to act on behalf of the football championship subdivision members of the Board of Directors on legislative issues specific to championship subdivision football in accordance with Constitution 5.3.2.2.4 (see Constitution 5.1.4.3.4)."

Rationale: Under the present representative governance structure, only four football championship subdivision conferences have seats on the Board of Directors. As a result, a minority of football championship subdivision conferences control the fate of legislation that affects the entire subdivision. Such a situation can result, and indeed has resulted, in the defeat of legislation that enjoys the support of the majority of football championship subdivision conferences. Moreover, the current voting procedures used for football championship subdivision specific issues places the four football championship subdivision representatives on the Board of Directors in an extremely difficult position when the opinion held by the majority of football championship subdivision conferences is contrary to the position held by the conference represented by the Board member. This proposal addresses these concerns and gives all football championship subdivision conferences an equal voice in the decision-making process by providing the football championship subdivision members of the Presidential Advisory Group the authority to act on football championship subdivision specific legislation.

S.   Administrative: Amend 30.10, as follows:

"30.10 CONTEST EXEMPTIONS/CERTIFICATION. In order for an institution, or an institution located in Alaska, Hawaii, Puerto Rico or the Virgin Islands that has a sport classified in Division I (in sports other than basketball), to exempt specified contests from its maximum number of contests within Bylaw 17, the contests shall be certified annually by the Championships/Competition Cabinet as meeting the following conditions. In sports other than  basketball and football, the Championships/Competition Cabinet Subcommittee on Certified Events shall have the authority to certify an event for a two-year period, provided the event has been certified for five consecutive years and audited financial reports and other documents required for certification are submitted on an annual basis.

"30.10.1 Sports Other Than Basketball and Football.  The following criteria must be satisfied for a contest or event to receive certification from the Championships/Competition Cabinet in sports other than basketball and football.

"30.10.1.1 Application Deadline.  The application for a certified event must be received by the Championships/Competition Subcommittee on Certified Events not later than October 15 (for fall events) or April 15 (for winter and spring events) preceding the academic year in which the event will be conducted.

"30.10.1.2 Competitive and Cultural Experience.  Each certified event must provide participating student-athletes a unique competitive and/or cultural experience. The committee will review an annual report submitted by the event to determine whether the event meets this criterion.  If a sponsoring agency wishes to conduct a certified event in a U.S. state or territory outside of the contiguous 48 states (e.g., Alaska, Hawaii, Puerto Rico, Virgin Islands), all competition in the event must take place within such state or territory.  

"30.10.1.3 Sponsoring Agency.  The sponsoring organization shall be either an active or affiliated member or a member conference of the Association. An institution that is a sponsoring organization must conduct the applicable sport on the intercollegiate level. For certified events in Alaska, Hawaii or Puerto Rico, the sponsoring agency must be an active or provisional NCAA member located in that state or territory.

"30.10.1.4 Venue.  A certified event shall not be conducted in a venue where sports wagering on intercollegiate athletics is permitted or on property sponsored by an establishment that permits sports wagering on intercollegiate athletics or branded with signage for such an establishment.

"30.10.1.5 Team Selection. The NCAA institution sponsoring the certified event must be responsible for team selection, which must be open to all Division I members.

"30.10.1.6 Management of Event.  Each event must demonstrate that its administration is experienced in managing such events, that competition is conducted in a manner compatible with Division I standards and that it is financially sound. A sponsoring organization, at its own expense, may be required to appear before the Championships/Competition Cabinet Subcommittee on Certified Events.

"30.10.1.6.1 Participation by Division I Institution.  Each certified event must have at least one Division I institution directly participating in the management of the event for contests played within the 48 contiguous states. For exempted events in Alaska, Hawaii, Puerto Rico and the Virgin Islands, at least one NCAA institution in any division shall serve in this capacity.

"30.10.1.7 Financial Report.  An annual financial report must be filed by the sponsoring organization on a form and by a date approved by the Management Council. Sponsors shall be required to submit a financial report of the previous event as part of its application for future exemptions. The Association shall conduct an audit of each certified event once every five years.

"30.10.1.7.1 Sponsorship Fee.  The sponsoring organization of a certified event shall be required to pay a fee of $100 upon receipt of certification of the event.

"30.10.1.8 Insurance.  Sponsors of certified events shall carry general liability insurance and maintain primary comprehensive general coverage listing the NCAA as an additional insured, with combined single limits of at least $1 million per occurrence for bodily injury and property damage.

"30.10.1.9 Missed Class Time.  A certified event should be scheduled to minimize lost class time for the participating student-athletes.

"30.10.1.10 Certified Event Limitations.  An institution may participate in not more than one certified event in the same sport in the same year.

"30.10.1.11 Trademark.  The trademark of a certified event, if any, must be held by an NCAA institution.

"30.10.1.12 Officials.  Officials for certified events shall be assigned from an agency that regularly assigned officials for Division I institutions, and the official shall be experienced in officiating Division I contests in the applicable sport."

Rationale: The adoption of NCAA Proposal No. 2006-14 eliminated the event certification program in basketball, thereby resulting in the elimination of the certification process for more than 90 percent of the total number of events. Additionally, during the 2005-06 academic year, only nine events in all other sports were certified and only 11 events sought certification for 2006-07. Given the limited number of opportunities in these other sports, eliminating the certification process will foster competitive equity.
