2007-97 CHAMPIONSHIPS AND POSTSEASON FOOTBALL -- ELIGIBILITY FOR CHAMPIONSHIPS -- INELIGIBILITY FOR USE OF BANNED DRUGS -- DURATION OF INELIGIBILITY -- TIMING OF 365-DAY PERIOD

Status: Board of Directors Consideration  


Intent: To specify that a student-athlete who tests positive for a substance in a banned-drug class shall remain ineligible for all regular-season and postseason competition during the time period ending one calendar year after the collection of the student-athlete's positive drug-test specimen; further, to specify that if the student-athlete participates in any contests from the time of collection until the confirmation of the positive result, he or she must be withheld from an equal number of contests after the 365-day period of ineligibility.

 

A.    Bylaws: Amend 18.4.1.5.1, as follows:

"18.4.1.5.1 Duration of Ineligibility. A student-athlete who tests positive (in accordance with the testing methods authorized by the Executive Committee) shall be charged with the loss of a minimum of one season of competition in all sports if the season of competition has not yet begun for that student-athlete or a minimum of the equivalent of one full season of competition in all sports if the student-athlete tests positive during his or her season of competition (i.e., the remainder of contests in the current season and contests in the subsequent season up to the period of time in which the student-athlete was declared ineligible during the previous year). The student-athlete shall remain ineligible for all regular-season and postseason competition during the time period ending one calendar year (i.e., 365 days) after the collection of the student-athlete's positive drug-test specimen and until the student-athlete tests negative (in accordance with the testing methods authorized by the Executive Committee) and the student-athlete's eligibility is restored by the Committee on Student-Athlete Reinstatement.  If the student-athlete participates in any contests from the time of collection until the confirmation of the positive result, he or she must be withheld from an equal number of contests after the 365-day period of ineligibility."

B.     Administrative: Amend 31.2.3, as follows:

"31.2.3 Ineligibility for Use of Banned Drugs. Rationale: The current drug-testing legislation mandates a one-year penalty for any positive drug test and withholding from competition for a year beginning with the date of when the specimen is determined to be positive for a drug in a banned class. However, when a student-athlete requests and is granted reinstatement, the start of the 365-day period of ineligibility is calculated by using the date of when the specimen is collected rather than when it is determined to be positive. This proposal amends the current legislation to reflect the current practice used by student-athlete reinstatement when considering requests for reinstatement when a student-athlete tests positive for a drug in a banned class. This change is requested as noncontroversial legislation, inasmuch as broader consultation and debate are unlikely to improve the proposal in any substantial way, significant disagreement or alternative points of view will not be generated and there does not appear to be a significant impact on existing legislation or proposed legislation.

Intent: In women's basketball, to permit institutional coaching staff members to accept collect and toll-free telephone calls placed by a prospective student-athlete and the prospective student-athlete's parents and legal guardians, provided the calls are not placed earlier than the date on which an institution may begin placing telephone calls to the prospective student-athlete.

Bylaws: Amend 13.1.3.6, as follows:

"13.1.3.6 Collect and Toll-Free Telephone Calls.  Institutional coaching staff members (see Bylaw 13.1.3.4.1) may accept collect and toll-free (e.g., 1-800, 1-888) telephone calls placed by prospective student-athletes and prospective student-athletes' parents and legal guardians, provided the calls are placed not earlier than July 1 following completion of the prospective student-athlete's junior year in high school.

2007-106 ADMINISTRATIVE REGULATIONS -- FINAL FOUR BASKETBALL EVENT CERTIFICATION -- MEN'S BASKETBALL

Intent: In men's basketball, to eliminate the evaluation period and the basketball event certification process for an event held in conjunction with the NCAA Men's Final Four.
A.   Administrative: Amend 30.10.1, as follows:

"30.10.1 Basketball, Men's. The following recruiting periods shall apply to men's basketball:

In men's and women's basketball, coaches are permitted to attend a single basketball event selected at the discretion of the institution, certified by the NCAA and held in conjunction with and conducted within a 30-mile radius of the championship site and host city of the respective men's or women's NCAA Division I Women's Basketball Championship.  The opportunity to attend such an event is limited to one per institution and is available for all coaching staff members. Institutional staff members are precluded from in-person face-to-face contacts with prospective student-athletes during such events.  The following criteria must be met by each event in order to be certified:

Rationale: The Final Four event certification process was established to permit coaches to attend a single event designed to be a celebration of basketball. The process was not intended to create additional recruiting opportunities. The original event that prompted the current legislation involved a team of prospective student-athletes representing the United States against a foreign team, an event that is no longer conducted in conjunction with the Men's Final Four. Most, if not all, of the participants had committed or signed with various institutions. The limitation of attending one event also ensured that coaches maintained the opportunity to attend other meetings and activities conducted as part of the championship. Although several events meet certification criteria, they are not meeting the intent and spirit of the original legislation. Many take significant time from coaches and are not celebratory in nature. This proposal will reinstate a full dead period surrounding the championship, reinforce the celebratory nature of the weekend and reduce the pressure on coaches to engage in recruiting activities during this time period. This proposal is recommended as emergency or noncontroversial legislation so as to be effective before the 2008 championship and to provide ample time to inform event operators and coaches of the change.

2007-90 PLAYING AND PRACTICE SEASONS -- FIELD HOCKEY -- FIRST CONTEST OR DATE OF COMPETITION

Status: Board of Directors Consideration  

Intent: In field hockey, to specify that the first permissible contest date shall be the Friday prior to the 11th weekend prior to the start of the NCAA Division I Field Hockey Championship, except that an alumni contest may be played the weekend prior to the first scheduled contest.

Bylaws: Amend 17.10.3, as follows:

"17.10.3 First Contest or Date of Competition. A member institution shall not play its first contest or engage in its first date of competition (game or scrimmage) with outside competition in field hockey prior to the Friday prior to the 11th weeks weekend prior to the start of the NCAA Division I Field Hockey Championship, except that an alumni contest may be played the weekend prior to the first scheduled contest (see Bylaw 17.10.5.1.1 for scrimmage/exhibition games exception)."

Rationale: Throughout the playing season, institutions have the flexibility of scheduling contests on Fridays and Sundays, which provides additional recovery time for student-athletes between contests. This change makes the first weekend consistent with the rest of the season. Since the proposal moves the first contest date back by only one day, it has a minimal academic impact, if any. The NCAA Division I Field Hockey Committee and National Field Hockey Coaches Association support this change. This change is requested as noncontroversial legislation so that the effect on scheduling may be minimized. In addition, broader consultation and debate are unlikely to improve the proposal in any substantial way, significant disagreement or alternative points of view will not be generated and there does not appear to be a significant impact on existing legislation or proposed legislation.

"13.1.8.8 Basketball Evaluations.

"(a) Men's Basketball.  In men's basketball, each institution is limited to 130 recruiting-person days (see Bylaw 13.02.7) during recruiting periods (contact and evaluation periods) that occur during the academic year.

Rationale: There has been an escalation in the number of impermissibly arranged activities disguised as open gym or pick-up games during the summer evaluation period. These activities subject coaches to potential rules violations and can create an environment in which contact between NCAA coaches and outside influences occur. Currently, men's basketball coaches are not permitted to attend these activities during the academic year. This proposal will expand this prohibition to include the summer. Finally, the NCAA Division I Academics/Eligibility/Compliance Cabinet Subcommittee on Recruiting and the National Association of Basketball Coaches support this recommendation and agree that adopting it as noncontroversial legislation is appropriate so it will be effective for the summer 2008.

Intent: To specify that the following additional criteria must be satisfied in order for a summer basketball league or a basketball event to be certified: (1) No individual or agency involved in the marketing of any individual's athletics reputation or ability (including an employee of an agent or anyone associated with an agent in his or her capacity of marketing any individual's athletics reputation or ability) shall be associated in any capacity with the league or event (or any team participating in the league or event); and (2) The league or event operator is required to provide proof of medical insurance coverage for participants.

 

A.   Administrative: Amend 30.14, as follows:

"30.14 SUMMER BASKETBALL LEAGUES. In order for a summer basketball league to be certified, a certification application form must be submitted each year to the NCAA national office.  To be certified, the following criteria must be met by each league:

"(i) Operation and Management Involvement of AgentsThe league (and any team participating in the league) shall not be operated or managed by any No individual or agency involved in the marketing of any individual's athletics reputation or ability (including an employee of an agent or anyone associated with an agent in his or her capacity of marketing any individual's athletics reputation or ability) shall be associated in any capacity with the league (or any team participating in the league); and

"(j) Awards.  League participants may receive an award, provided the cost of the award is included in the participant's entry fee.; and

B.   Administrative: Amend 30.15, as follows:

"30.15 SUMMER BASKETBALL EVENT CERTIFICATION -- MEN'S BASKETBALL. In men's basketball, in order for a summer basketball event (e.g., camp, league, tournament or festival) to be certified, a certification application form must be submitted each year to the NCAA national office 45 days before the start of the event.  An event review form for each event also must be submitted to the national office not later than three months after the event sessions.  The following criteria must be met by each event in order to be certified:

Rationale: Current legislation governing NCAA certified events and leagues prohibits events, leagues and teams from being managed, operated by or receiving any financial support from sports agents. However, a trend is emerging for persons employed by or associated with agents (e.g., runners) to engage in these activities on behalf of the agents. In order to enforce the intent of the original legislation prohibiting agent involvement, the legislation needs to be amended to specify that the prohibition applies to any person associated with an agent. The recommendation relating to medical insurance is intended to ensure that the prospective student-athletes and student-athletes participating in certified events and leagues, respectively, are provided adequate financial protection in the event of injury. Finally, the NCAA Division I Academics/Eligibility/Compliance Cabinet Subcommittee on Recruiting and the National Association of Basketball Coaches support this recommendation and agree that adopting it as noncontroversial legislation is appropriate so it will be effective for the summer 2008.
