The NCAA Division I Legislative Review and Interpretations Committee telephone conference was called to order at 3 p.m. All members were present as noted above.

 

 

Financial Aid Available to Children of Former Student-Athletes

 

1.                  Providing Financial Aid to the Children of Former Student-Athletes. (I) The committee determined that it is not permissible to award financial aid through a scholarship program available only to children of former student-athletes, even if participation on a team coached by a former coach or membership in a club (e.g., letterman?s club) that includes individuals other than former student-athletes is required. However, if an institution


meets the demonstrated financial need for all students through the use of institutional scholarships or grants, it would be permissible to award financial aid through a scholarship program available to children of former student-athletes as one of its sources of aid. SUBJECT: Agenda Items for November 14 call (Conference Call No. 18).

 

 

The following interpretation request will be considered during the telephone conference scheduled for 3 p.m. Eastern time Wednesday, November 14, by the NCAA Division I Legislative Review and Interpretations Committee (hereafter referred to as ?committee?).

 

 

Financial Aid Available to Children of Former Student-Athletes

 

1.      Issue.

 

Whether the June 13, 2007 official interpretation regarding scholarship funds for former student-athletes should be modified.

 

See Attachment A.

 

2.      Facts.

Subsequent to the June 13, 2007 call and prior to the NCAA Division I Management Council?s review of the interpretation, the staff revised its position on the original issue after gaining a better understanding of the specific facts. Accordingly, Management Council did not approve the official interpretation during its October meeting

3.                  Staff Position.

As a result of staff?s revised position, the staff believes the June 13, 2007 official interpretation should be modified to address future situations similar to the requesting institution (i.e., institution meets demonstrated need for all students) where neither an extra benefit nor recruiting inducement are present. Further, the staff believes the committee should consider the guidance provided by the former Legislative Review and Interpretations Subcommittee in its 2001 review of the issue (Attachment C). At that time, an official interpretation was not rendered; however, several institutions are aware of the subcommittee?s position and are using it to create similar scholarship funds. The staff believes a re-examination of the broad issue and a modified official interpretation would be helpful in clarifying the issue.
