REPORT OF THE NCAA DIVISION I MANAGEMENT COUNCIL

LEGISLATIVE REVIEW SUBCOMMITTEE

NOVEMBER 16, 2007

 

 

 

The NCAA Division I Management Council Legislative Review Subcommittee (LRS) convened in Indianapolis, Indiana, November 16 to review the proposals set forth in the 2008 NCAA Division I Official Notice for the purpose of providing recommendations and comments for consideration by the full NCAA Division I Management Council as it takes initial action on the proposals at its January 13, 2008, meeting. The recommendations, additional comments and page numbers of the proposals as they appear in the official notice are referenced in the charts listed below.  The subcommittee’s report will appear in two charts.  The first chart reflects the subcommittee’s recommendations/comments to the Management Council and is divided into categories based on the subcommittee’s positions.  The second chart reflects the subcommittee’s recommendations/comments and lists the proposals in the order they appear in the official notice.  Please note that if the subcommittee is recommending the Management Council to approve a proposal and forward it to the NCAA Division I Board of Directors for possible adoption, the subcommittee supported the rationale for the proposal as indicated by the sponsors in the rationale statement.  Further, if the subcommittee recommends that the Management Council defeat a proposal, it is likely that the subcommittee agreed with an opposition statement of a referral entity included in the official notice with the proposal.

PLAYING AND PRACTICE SEASONS -- WOMEN'S SOCCER -- FIRST CONTEST OR DATE OF COMPETITION

To specify that in years in which the date of the first permissible contest in men's soccer results in 12 weeks between that date and the start of the NCAA Division I Men's Soccer Championship, the date for the first permissible contest in women's soccer shall be the Friday prior to the 12th weekend prior to the start of the NCAA Division I Women's Soccer Championship, except that an alumni contest may be played the previous weekend.

PERSONNEL -- LIMITATIONS ON THE NUMBER AND DUTIES OF COACHES -- REPLACEMENT FOR NATIONAL OR OLYMPIC TEAM COACHES

To specify that an institution may replace, on a temporary or limited basis, a coach who takes a leave of absence to participate on or coach the national team or Olympic team of another nation.

AMATEURISM -- GENERAL REGULATIONS -- EDUCATIONAL EXPENSES -- PRIOR TO COLLEGIATE ENROLLMENT -- PERMISSIBLE EXPENSES OR SERVICES

To specify that a prospective student-athlete may receive educational expenses or services related to tutoring and standardized test preparatory classes from any individual or entity other than an agent, professional sports teams/organization or a representative of an institution's athletics interests, provided such expenses are disbursed directly to the individual, organization, or educational institution providing the educational service.

AMATEURISM -- GENERAL REGULATIONS -- PREFERENTIAL TREATMENT, BENEFITS OR SERVICES -- RESTITUTION

To specify that for violations of the preferential treatment legislation in which the value of the benefit is $100 or less, the eligibility of the individual shall not be affected, conditioned on the individual repaying the value of the benefit to a charity of his or her choice; further, to specify that the individual shall remain ineligible from the time the institution has knowledge of receipt of the impermissible benefit until the individual repays the benefit.

To permit an institution to conduct one formal press conference to announce the signed commitments of prospective student-athletes and to permit coaching staff members to attend functions designed to celebrate the institution's signees in the applicable sport and discuss prospective student-athletes who have signed commitments to attend the institution, including discussions with working media, provided the institution previously has released communications of the prospective student-athletes' commitments to attend the institution to media outlets.

In men's lacrosse, to specify that lacrosse evaluations are not permissible from the day after the first Sunday in January through Martin Luther King Jr. Day and from September 1 through October 31; further, to revise the men's lacrosse recruiting calendar, as specified.

ELIGIBILITY -- CERTIFICATION OF ELIGIBILITY -- INSTITUTIONAL RESPONSIBILITY -- DE MINIMIS VIOLATION

To specify that a violation in which the institution fails to certify a student-athlete's eligibility prior to allowing him or her to represent the institution in intercollegiate competition shall be considered an institutional violation per NCAA Constitution 2.8.1; however, such a violation shall not affect the student-athlete's eligibility, provided all the necessary information to certify the student-athlete's eligibility was available to the institution and the student-athlete otherwise would have been eligible for competition.

To increase the maximum number of contests or dates of competition in which a student-athlete may participate in a season and remain eligible for a season-of-competition waiver to three events or 30 percent of the institution's scheduled or completed events in his or her sport.

ELIGIBILITY -- FRESHMAN ACADEMIC REQUIREMENTS -- ELIGIBILITY FOR FINANCIAL AID, PRACTICE AND COMPETITION -- QUALIFIER -- EXCEPTION -- EARLY ACADEMIC CERTIFICATION

To specify that a prospective student-athlete shall be certified as a qualifier, provided he or she has achieved (a) A minimum combined score on the SAT verbal and math sections of 1000 or a minimum sum score on the ACT score of 85, per the requirements of Bylaw 14.3.1.3; and (b) A core-course grade-point average of 3.00 or higher (based on a maximum of 4.000) in a minimum of 13 core courses on completion of six semesters (or the equivalent), including three core courses in English, two in mathematics, two in natural or physical science, and six additional core courses in any NCAA core area.

ELIGIBILITY -- PROGRESS-TOWARD-DEGREE REQUIREMENTS -- BONA FIDE FOREIGN EXCHANGE STUDENT EXCEPTION

To specify that the eligibility for competition of a student-athlete who meets the bona fide foreign exchange student exception to the transfer legislation shall be based on satisfactory completion of at least: (a) Six semester or six quarter hours of academic credit during the preceding regular academic term in which the student has been enrolled full time at any collegiate institution; (b) Eighteen semester or 27 quarter hours per regular academic year of enrollment; and (c) A minimum grade-point average per academic term of enrollment as required of regularly enrolled student-athletes.

To require that an institution annually submit its race and demographic information to the NCAA in order to be eligible to enter a team or individual in NCAA championship competi-tion.

To require that a reclassifying multidivisional institution engage in a compliance review (at the institution's expense) during the two-year reclassification process; further, to require that an active multidivisional institution engage in a compliance review (at the institution's expense) once every four years and that the review be conducted by an entity outside the athletics department (e.g., multi-sport conference, outside consultant), subject to approval by the Division I Management Council Membership Subcommittee.
