[Note:  While certain items in the Management Council’s agenda were acted upon by the Management Council at various times throughout the meeting, all final actions with a given topic are combined in these minutes for convenience of reference.  Also, these minutes reflect only actions (formal votes or “sense of meeting”), in accordance with the established policy governing minutes of all NCAA entities.  The only discussion included is that ordered by the chair or a member of the group.]

 

 

The meeting was called to order at 8:08 a.m. by the chair, Ms. Willson.  All members were present as noted previously.

 

 

1.         Announcements.  Ms. Willson welcomed the new members to the Management Council and noted that Marcie Reynolds was absent.

 

 

2.         Review of Previous Minutes.

 

a.         Minutes of January 6, 2006, Management Council Meeting.

“That the Management Council approve the minutes of the January 6 Management Council meeting, as distributed.”

 

b.         Minutes of January 9, 2006, Management Council Meeting.

c.         Minutes of January 7, 2006, Presidents Council Meeting.  The Management Council reviewed the minutes of the January 7 Presidents Council meeting.  No formal action was taken.

 

d.         Minutes of the January 9, 2006, Executive Committee Meeting.  The Management Council reviewed the minutes of the January 9 Executive Committee meeting.  It was noted that the listing of participants was incorrect, in that Paul Engelmann and Kathryn Martin did not attend the meeting.  Jill Willson, as the incoming Management Council chair, did participate.  No formal action was taken.

 

e.         Minutes of the February 1, 2006, Administrative Committee Teleconference.

“That the Management Council approve the minutes of the February 1 teleconference, as distributed.”

 

 

3.         Division II Strategic Plan Accomplishments.  The Management Council reviewed the listing of completed initiatives taken from the Division II strategic plan.  No formal action was taken.

 

 

4.         Committee Recommendations Affecting Division II.

 

a.         Association-wide and Common Committees.

 

(1)        Competitive Safeguards and Medical Aspects of Sports Committee.

 

(a)        2004-05 Drug-Testing Results.

 

It was VOTED

 

“That the Management Council approve for publication the results of the NCAA drug-testing program for the period from 2004-05, effective immediately.”

 

(b)        University of California, Los Angeles, Laboratory Training.

 

It was VOTED

 

“That the Management Council recommend that the Presidents Council permit committee members to attend drug-testing training at the UCLA Sports Analytical Laboratory in Spring 2007.”

 

(c)        Coaches Sport Safety Training.

 

It was VOTED

 

“That the Management Council recommend that the Presidents Council sponsor legislation for the 2007 NCAA Convention to mandate that all coaches who conduct practice, competition, skill instruction, and strength and conditioning sessions be certified in first aid and cardiopulmonary resuscitation and to have reviewed emergency plan activation policies, effective August 2007.”

 

(d)        Bylaw 31.2.3.5 (Medical Exceptions).

 

It was VOTED

 

“That the Management Council recommend that the Presidents Council adopt an administrative regulation to amend Bylaw 31.2.3.5 (medical exceptions) so that the banned drug class (b) Anabolic Agents be added to the list of classes for which a medical exception may be requested, effective August 2006.  Further, it was recommended that this administrative change be an Association-wide common provision.”

 

(e)        Committee Chair.

“That the Management Council recommend that the Presidents Council ratify the appointment of Jerry Koloskie, senior associate director of athletics, University of Nevada, Las Vegas, as the chair of the committee, effective September 1, 2006.”

 

(2)        Minority Opportunities and Interests Committee.  The Management Council reviewed the committee’s report.  No formal action was taken.

 

(3)        Olympic Sports Liaison Committee.

 

(a)        NCAA/USOC Task Force Value Statement. 

 

It was VOTED

 

“That the Management Council endorse the value statement from the NCAA/USOC Task Force report, as follows:

 

[Insert name of organization or institution] believes that participation in intercollegiate athletics represents a uniquely valuable educational experience for student-athletes and enriches the quality of campus life generally.  As such, there is great benefit, consistent with the academic mission of American colleges and universities, in ensuring that diverse athletic opportunities are available to students, especially in those sports that connect to the Olympic ideals, inspire young people and attribute to a lifelong commitment to fitness.  We are committed to doing all we reasonably can to help ensure that those diverse athletic opportunities continue to exist as part of intercollegiate athletics in America.”

 

(b)        Bylaw 16.8.1.3 (Expenses Provided by the Institution for Practice and Competition––Other Competition).

 

It was VOTED

 

“That the Management Council adopt noncontroversial legislation to amend Bylaw 16.8.1.3 (b) to permit institutions to provide expenses for student-athletes to participate in one qualifying competition for each of the listed elite events per academic year.”

 

(4)        Postgraduate Scholarship Committee.  The Management Council reviewed the committee’s report, noting that one of the awardees was Cory Cangelosi, a Division II Student-Athlete Advisory Committee member.  No formal action was taken.

 

(5)        Committee on Women’s Athletics––Male Practice Players.

 

It was VOTED

 

“That the Management Council refer the recommendation concerning the issue of male practice players to the Division II Student-Athlete Advisory Committee and the Division II Championships Committee for their review and recommendation.”

 

[Note that the issue will also be taken by Management Council representatives back to their conference meetings for feedback at the July Management Council/Student-Athlete Advisory Committee Summit.]

 

b.         Division II Committees.

 

(1)        Academic Requirements Committee––Bylaw 14.5.4.1 (Eligibility for Competition, Practice and Athletics Aid.

 

It was VOTED

 

“That the Management Council recommend that the Presidents Council sponsor legislation for the 2007 NCAA Convention to amend NCAA Bylaw 14.5.4.1 (eligibility for competition, practice and athletics aid) by adding a new bylaw to permit a transfer student from a two-year college, who has not previously attended a four-year collegiate institution and who was a qualifier, to be eligible for competition at a Division II institution during the student’s first academic year in residence only if the student has spent at least one full-time semester or one full-time quarter in residence at the two-year college (excluding summer sessions).  Also, the transfer student must have presented a minimum grade-point average of 2.000 and satisfactorily completed an average of at least 12-semester or 12-quarter hours of transferable-degree credit acceptable toward any baccalaureate degree program at the certifying institution for each full-time academic term of attendance at the two-year college.”

 

(2)        Budget and Finance Committee.

 

(a)        Guiding Principles.

 

It was VOTED

 

“That the Management Council recommend that the Presidents Council approve amending Guideline No. 6 of the Division II budget guiding principles, to state that the membership trust reserve maintain a three-year average balance of $3,000,000.  For averaging purposes, this would include the prior, current and subsequent years.”

 

(b)        Biennial Budget Requests.

 

It was VOTED

 

“That the Management Council recommend that the Presidents Council approve the Division II biennial budget requests, as presented.”

 

(c)        Budget to Actual Results.  The Management Council reviewed the budget-to-actual results as of January 31.  No formal action was taken.

 

(3)        Championships Committee

 

(a)        Appointments.

“That the Management Council ratify the following sports and sports rules committee appointments, effective September 1, unless otherwise noted.

 

(i)         Baseball.  Nathan Salant, commissioner, Gulf South Conference, to replace Britt Bonneau, head coach, Abilene Christian University, and Jon McBride, athletics director, University of Nebraska at Kearney, to replace J. R. Smith, commissioner, Rocky Mountain Athletic Conference.

 

(ii)        Men’s Basketball.  Claudie Mackey, faculty athletics representative, Elizabeth City State University, to replace H. (b)        Playing and Practice Seasons Request.  The Management Council noted that, per its request, the committee had reviewed Bylaw 17.1.5.2.1 (skill instruction) and agreed to forward the legislation to Division II sports committees for their comment with regard to possible amendments.  No formal action was taken.

 

(c)        Regionalization.  The Management Council received an update concerning Division II regionalization.  Considerable discussion ensued.

 

It was VOTED

 

“That the Central Intercollegiate Athletic Association be moved from the Atlantic region to the Southeast region.”  [Defeated––5 for; 13 against]

 

It was VOTED

 

That contests between the Southern Intercollegiate Athletic Conference and the Central Intercollegiate Athletic Association be counted as in-region contests.”  [Defeated––6 for; 13 against]

 

It was VOTED

 

“That the Management Council endorse a new regional structure to support the regionalization policy for Division II championships selection that divides the United States into eight regions for most sports.” [Passed––14 for; 4 against; 2 abstentions]

 

[Note that the Championships Committee will review relevant information related to historical conference/institutional rivalries to determine whether a principle should be established.]

 

[Note that the regionalization structure is consistent with Division II’s philosophy, which is to group schools by geographic area to limit missed class time and reduce travel costs and is more consistent and understandable then the current policy on regionalization, which is very sport-specific.  This structure will become effective for all sports beginning with the 2008-09 academic year; however, individual sports committees may determine to implement the new policy for a the 2007-08 academic year, particularly if there are few changes.]

 

(4)        Committee on Infractions––Administrative Regulations.

 

It was VOTED

 

“That the Management Council recommend that the Presidents Council adopt the following administrative regulations:

 

(a)        Bylaw 32.2.1.1 (Staff Initiation of Investigation).  To modify Bylaw 32.2.1.1 to clarify when the enforcement staff may initiate an investigation.

 

(b)        Bylaw 32.2.2.1.2 (Identification of Major/Secondary Violation).  To amend Bylaw 32.2.2.1.2 to clarify that the enforcement staff may submit information to the Committee on Infractions for an initial determination of whether the case should be processed as a major or secondary case.  This amendment would give the enforcement staff the option to consult with the Committee on Infractions for guidance and memorializes that option.

 

(c)        Bylaw 32.3.7 (Disclosure of Purpose of Interview).  To modify Bylaw 32.3.7 to specify that the enforcement staff must provide notice to certain individuals at the beginning of an interview to the effect that refusing to furnish information or providing false or misleading information may result in an unethical conduct charge.

 

(d)        Bylaw 32.6.2 (Notification to Enforcement Staff).  To modify Bylaw 32.6.2 to require individuals charged with a major violation to submit a response to the Committee on Infractions and to specify that failure to submit a response may be viewed by the committee as an admission that the alleged violations occurred.

 

(e)        Bylaw 32.6.5 (Deadline for Institutional Response).  To modify Bylaw 32.6.5 to specify that all parties in an infractions case must share their responses with each other.

 

(f)        Bylaws 32.3.9.1 (Tape Recording(s)), 32.3.9.1.1 (Access to Tape Recording(s)), 32.3.9.1.4 (Statement of Confidentiality), 32.3.9.2 (Non-Recorded Interviews), 32.3.10 (Enforcement Staff’s Responsibility to Maintain a Case File and Access to Information to be Used in Presentation of Case).  To editorially revise various bylaws (32.3.9.1; 32.3.9.1.1; 32.3.9.1.4; 32.3.9.2; and 32.3.10) to change the wording from “tape recordings” to “recordings” because the enforcement staff now uses digital recording devices rather than tape-based recorders.”

 

(5)        Legislation Committee.

 

(a)        Report.

 

(i)         Interpretations.

“That the Management Council approve the following interpretations:

 

·                     Increase of Institutional Aid - Equivalency Computations.  (II)  A student-athlete who is receiving only nonathletically related institutional financial aid may receive an initial award of athletically related institutional financial aid at any point during the period of the nonathletically related award.  The committee also determined that if a student-athlete becomes a counter at any point during the academic year, all countable institutional aid received during that academic year is countable toward the student-athlete’s equivalency. [References:  Division II Bylaws 15.3.4.2 (increase permitted), 15.5.1 (counters) and 15.5.2.2 (equivalency computations); and a 9/7/88 staff interpretation, item f, which has been archived.]

 

·                     Eligibility of Transfer Student-Athlete for Competition in Year of Transfer. (II)  If the institution from which a student-athlete transfers at midyear declares separate nonchampionship and championship segments of its playing and practice season, a student-athlete may compete during the nonchampionship segment for such an institution and during the championship segment for the certifying institution during the same academic year in the same sport, provided the applicable transfer and progress-toward-degree eligibility requirements are satisfied. ·                     Telephone Calls to Prospects After the Limit on Calls during a Particular Time Period is Reached.(II)  Once an institution has made a countable telephone call to a prospect or a prospect's relatives or legal guardian(s) that results in the limit on calls for the particular time period being reached (e.g., one per month, one per week, two per week), the institution may not initiate an additional telephone call during the same time period, even if no direct conversation occurs during the second call (e.g., voicemail message). ·                     Participation in Junior Levels of Pan American, World Championship and World Cup Tryouts and Competition as an Exception to Outside Competition. (II)  A student-athlete's participation in junior levels of Pan American, World Championship and World Cup tryouts and competition qualifies as an exception to the outside competition rule in all sports. ·                     Eligibility for a Waiver of the Full-Time Enrollment Requirement for Participants in Junior Levels of the Pan American Games, World Championships and World Cup Competition. (II)  A student-athlete's participation in junior levels of the Pan American Games, World Championships and World Cup competition would permit an institution to seek a waiver of the minimum full-time enrollment requirement for practice and competition. ·                     2006 NCAA Convention Proposal No. 22 (Eligibility - Four-Year College Transfers - One-Time Transfer Exception - Final Season of Competition or Final Two Full-Time Semesters or Three Full-Time Quarters).  (II)  Under 2006 NCAA Convention Proposal No. 22, a transfer student-athlete is able to meet the credit-hour condition of subsection (e) of the one-time transfer exception, even if the certifying institution is limited in accepting a maximum number of transferable degree credits toward any of its baccalaureate degree programs, and that number of accepted degree credits is less than the number of transferable credits that the student-athlete is required to transfer under the proposal.  Institutional policy designed to limit the maximum number of transferable credits will not prevent the student-athlete from meeting subsection (e), provided the student-athlete has satisfactorily completed enough, normally transferable, degree credits acceptable toward any baccalaureate degree program to satisfy subsection (e).  

For example, a student-athlete has two full-time semesters remaining in which to complete his or her eligibility and has not earned a baccalaureate degree.  The student-athlete wants to transfer from Institution A to Institution B.  While at Institution A, the student-athlete satisfactorily completed 104 credits.  Under Institution B's policy, the institution is limited in accepting a maximum of 90 transferable credits, even if a transfer student has earned more, normally transferable, degree credit hours.  Institution B requires the remainder of the credits required for graduation must be completed at its institution.  Since the student-athlete has been enrolled in eight full-time semesters, he or she would be required to have satisfactorily completed a total of 96 semester hours of transferable degree credit toward any of the institution's baccalaureate degree programs (i.e., eight full-time semesters x 12 credits = 96 credits) to satisfy the credit-hour condition of subsection (e) in Proposal No. 22.  However, because of Institution B's policy, the institution will only accept 90 transferable credits.  Under this proposal, the student-athlete will be immediately eligible to compete at Institution B if the institution verifies that six other credit hours would have transferred to any of its baccalaureate degree programs, but for the policy, and if the student-athlete fulfills the other requirements of the one-time transfer rule. ·                     Transportation to Enroll.  (II)  An institution may provide transportation from the nearest bus or train station or major airport to the campus on the occasion of a prospective student-athlete's initial arrival at the institution to attend classes, including the prospective student-athlete's initial arrival to attend classes in a summer term, or the prospective student-athlete's initial arrival at the institution to participate in preseason practice activities when the prospective student-athlete will be remaining in the locale of the institution to begin classes.  [Reference: Division II Bylaw 13.5.4 (transportation to enroll), and an official interpretation (reference:  4/10/01, Item No. 1, which has been archived.)]”

 

(ii)        Incorporation of Interpretations into the Manual.

“That the Management Council approve the following incorporation of interpretations into the Division II Manual:

(iii)       2007 NCAA Convention Legislation.

 

·                     Bylaw 12.5.1.6 (Amateurism––Promotional Activities––Permissible––Educational Products Related To Sport-Skill Instruction).

 

It was VOTED

 

“That the Management Council recommend that the Presidents Council sponsor legislation for the 2007 NCAA Convention to amend Bylaw 12.5.1.6 (educational products related to sport-skill instruction) to permit a student-athlete to receive actual and necessary expenses for participation in activities involving educational products related to sports-skill instruction, effective immediately.  Further, to specify that a student-athlete shall not miss class to participate in the activity.”

 

·                     Bylaw 14.5.5.3.9 (Eligibility––Transfers-–Nonrecruited Student Exception).

 

It was VOTED

 

“That the Management Council recommend that the Presidents Council sponsor legislation for the 2007 NCAA Convention to amend Bylaw 14.5.5.3.9 (nonrecruited student exception) to permit a student-athlete to use the nonrecruited student exception to the transfer residency requirement, provided he or she has not competed for any previous institution and has not engaged in countable athletically related activities in intercollegiate athletics at any previous institution beyond a 14 consecutive-day period, which begins with the date on which the student-athlete first engages in countable activities.”

“That the Management Council recommend that the Presidents Council sponsor legislation for the 2007 NCAA Convention to amend Bylaws 14.4.3.4-(e), 14.5.4.4.3 and 14.5.5.3.7 (two-year nonparticipation exception) to permit a student-athlete to use the two-year nonparticipation exception to the transfer residency requirement or the progress-toward-degree requirements, provided he or she has not competed in intercollegiate competition and has not engaged in other countable athletically related activities in intercollegiate athletics beyond a 14 consecutive-day period, which begins with the date on which the student-athlete first engages in countable activities. “
