2002 NONCONTROVERSIAL LEGISLATIVE PROPOSALS

Summary of Recommendations

 

ACTION ITEMS -- MANAGEMENT COUNCIL ONLY

1.

ISSUE:

Proposal No. 2 -- Committees – Association-Wide And Common Committees with Rules Administration Responsibilities (NCAA Bylaw 21.2.1.2).

Committee’s Recommendation:

 

Approve draft legislation to amend Bylaw 21.2.1.2 to specify that at least 50 percent of total positions on Association-wide and common committees with rules administration responsibilities shall be filled by coaching staff members.

Management Council Action:

 

Approved the draft noncontroversial legislative proposal.

ISSUE:

Proposal No. 3 -- Committees – Men's and Women's Skiing Committee – Composition Exception (Bylaw 21.3.1.2).

Committee’s Recommendation:

 

Approve draft legislation to amend Bylaw 21.3.1.2 to exempt the Men's and Women's Skiing Committee from the requirement that at least 25 percent of the positions be filled by noncoaching staff members.

Management Council Action:

 

Referred back to the Men's and Women's Skiing Committee, requesting greater rationale to justify the exception. The Council noted concerns regarding the request to exempt the committee from the requirement that at least 25 percent of the positions be filled by noncoaching staff.

ISSUE:

Proposal No. 4 -- Committees – Men's and Women's Skiing Committee (Bylaw 21.3.5).

Committee’s Recommendation:

 

Approve draft legislation to amend Bylaw 21.3.5 to specify that the composition of the Men's and Women's Skiing Committee shall include two coaches who represent alpine skiing and two coaches who represent nordic skiing; further, to specify that the secretary-rules editor may be counted toward meeting this requirement.

Management Council Action:

 

Deferred action pending committee feedback on composition exception (Proposal No. 3 -- Bylaw 21.3.1.2).

 

ITEMS OF INFORMATION

1.

ISSUE:

Proposal No. 1 -- Division III Management Council -- Vacancies (Constitution 4.7.2).

Committee’s Recommendation:

 

Draft legislation to amend Constitution 4.7.2 to permit the Presidents Council or the Management Council to waive the application of Constitution 4.7.2 for the Student-Athlete Advisory Committee representatives selected to serve on the Management Council.

Management Council Action:

 

Previously approved the draft noncontroversial legislative proposal.

2.

ISSUE:

Proposal No. 5 -- Enforcement -- Deadline for Submission of Written Materials (Bylaw 32.5)

Committee’s Recommendation:

 

Legislation to amend Bylaw 32.5 to specify that all written materials considered by the Committee on Infractions at an infractions hearing must be received at least 10 days prior to the hearing.

Management Council Action:

 

Previously approved the draft noncontroversial legislative proposal.
