PRESIDENTS COUNCIL ACTION ITEMS

1.

ISSUE:

Sponsorship of Legislation Relating to Bylaw 14.1.6.2.5 -- Extension Courses.

Committee’s Recommendation:

 

Sponsor legislation for the 2002 NCAA Convention to amend the provisions of Bylaw 14.1.6.2.5 consistent with the new definition of "nontraditional" courses drafted by the NCAA Division III Management Council Subcommittee on Academic Issues.

Management Council Recommendation:

 

Sponsor legislation.

2.

ISSUE:

Deletion of NCAA Constitution 5.3.11.4 -- Special Voting Requirements -- Voting on Football Issues.

Committee’s Recommendation:

 

Delete the provisions of Constitution 5.3.11.4.

Sponsor legislation.

ACTION ITEMS -- MANAGEMENT COUNCIL ONLY

1.

ISSUE:

Editorial Revision -- NCAA Bylaw 17.5.5.3-(e) -- Annual Exemptions -- Scrimmages.

Committee’s Recommendation:

 

Editorially revise Bylaw 17.5.5.3-(e) to indicate that the two informal practice scrimmages may be played between the first permissible date for on-court practice and the conclusion of the basketball season.

Management Council Action:

 

Agreed to editorially revise Bylaw 17.5.5.3-(e) and to incorporate the official interpretation of 2000 Proposal No. 52 issued October 2000 to include only preseason scrimmages (per Bylaw 14.2.4.1).

ISSUE:

Interpretation of Competition in the Nontraditional Segment.

Committee’s Recommendation:

 

Approve the following interpretation relating to competition in the nontraditional segment.

"Consistent with the intent of 2000 NCAA Convention Proposal No. 52, a student-athlete is charged with a season of competition when he or she competes in regular-season and/or post-season competition including competition conducted during the nontraditional segment."

Management Council Action:

 

Approved the interpretation and incorporated the official interpretation in the Manual to clarify impact on eligibility.

3.

ISSUE:

Editorial Revision Relating to Bylaw 17.1.9.2 -- Contest and Segment Limitations -- Dividing Traditional and Nontraditional Segments.

Committee’s Recommendation:

 

Editorially revise Bylaws 17.__.4 (End of Regular Playing Season – Nontraditional Segment) to indicate that an institution that conducts its nontraditional segment in the fall must complete all practice and competition by October 30 of the academic year involved; AND editorially revise Bylaw 17.__.2 (Preseason Practice – Nontraditional Segment) to indicate that a member institution that conducts its traditional segment in the fall may not begin practice or competition during its nontraditional segment until February 1 of the academic year involved.

Management Council Action:

 

Agreed to editorially revise segments of Bylaw 17 (end of regular playing season and preseason practice).

 4.

ISSUE:

Modification Based on Intent -- Bylaw 14.5.4.1.1 -- Two-Year Nonparticipation Exception.

Committee’s Recommendation:

 

Editorially revise Bylaw 14.5.4.1.1 to clarify that, in order to use this transfer exception, the student-athlete must satisfy both conditions. The committee agreed that this could be accomplished by changing the word "or" to the word "and."

Agreed to editorially revise Bylaw 14.5.4.1.1 based on intent.

  5.

ISSUE:

Sponsorship of NCAA Division I Proposal Nos. 2000-23 (Bylaw 21.3.4 -- Men's and Women's Skiing Committee) and 2000-24 (Bylaw 21.3.1.2 (Exception to Men's and Women's Skiing Committee).

Committee’s Recommendation:

 

Sponsor as noncontroversial legislation Division I Proposal Nos. 2000-23 and 2000-24 for Division III.

Management Council Action:

 

Agreed to sponsor noncontroversial legislation.

6.

ISSUE:

Exempted Preseason Scrimmage Opportunities.

Committee’s Recommendation:

 

Sponsor legislation for the 2002 Convention to permit individual and team sports, except for the spring sports of baseball, softball, lacrosse, rowing and water polo to be provided one preseason exempt scrimmage/date of competition, conducted in privacy and provided missed class time, during the preseason practice period. All current scrimmage opportunities would be replaced by the new opportunity. [Note: Spring sports have additional opportunities for competition and practice during the nontraditional segment, therefore eliminating the need to create an exempted scrimmage.

Management Council Recommendation:

 

Deferred action to April, requesting that the committee provide specific data to address the impact on each sport.

ITEMS OF INFORMATION

1.

ISSUE:

Deregulation -- Glossary of Terms.

Committee’s Recommendation:

 

The committee reviewed the first draft of the glossary of terms and made several editorial changes. The committee will review the revised version during its January 2001 in-person meeting.

 Management Council Action:

 

Accepted the information.

2.

ISSUE:

Review of Bylaw 17.

Committee’s Recommendation:

 

The committee intends to review Bylaw 17 to determine if other inconsistencies (similar to the scrimmage opportunities) exist.

Accepted the information.
