While certain items on the committee?s agenda were acted on at various times throughout the meeting, all final actions within a given topic are combined in these minutes for convenience of reference.]
The meeting was called to order at 8:05 a.m. Pacific time by the chair, Ms. Coffey. All members were present as noted above.
1. Welcome and Announcements. The NCAA Division III Interpretations and Legislation Committee welcomed Mr. Karner and Mr. Kerin to their first in-person meeting with the committee. The group thanked Mr. Dutcher for his attendance at the meeting, and congratulated Ms. Ekpo on her promotion to Division III Governance Liaison. Ms. Katz was also congratulated for her recent college graduation.
2. Committee Roster. The committee reviewed the current committee roster.
3. Approval of Previous Minutes. The committee reviewed the minutes of its May 20 teleconference.

?That the May 20, 2002, teleconference minutes be approved as written.?
4. LSDBi Phase III Presentation. Ms. Ekpo gave a presentation, highlighting the advances of LSDBi Phase III. The new advances include the ability for NCAA member institutions and conferences to submit legislative proposals via LSDBi.
5. Future of Division III. Mr. Dutcher spoke regarding the recent work of the NCAA Presidents Council/Management Council Joint Subcommittee on the Future of Division III.

NCAA Bylaws 14.02.3 (Definition of a Collegiate
Institution) and 14.2.3.2 (Definition of a Nonrecognized College). The committee discussed the multidivisional
definitions of a ?collegiate institution? and a ?nonrecognized college? for the
purposes of NCAA legislation. The
terminology in the affected bylaws is based on a classification system that the
Department of Education no longer uses.
Accordingly, it is no longer possible to apply the legisla-tion as it is
written. Based on recommendations from
staff, the committee supports amending NCAA Bylaws 14.02.3 and 14.2.3.2.

?That Management Council sponsor noncontroversial legislation to amend Bylaws 14.02.3 and 14.2.3.2.?
7. Review and Discussion of NCAA Bylaw 14.5.5.2.1 (Exception -- Four-Year College Transfers. In response to an inquiry from a member institution, the committee discussed the application of Bylaw 14.5.5.2.1 to situations in which a transfer student-athlete is not permitted to ?remain at his or her previous institution? (e.g., disciplinary suspension, etc.). The committee agreed that a student-athlete who is not permitted to remain at his or her previous institution would not meet the requirements of the transfer exception in Bylaw 14.5.5.2.1.

Review of NCAA Bylaw 13.1 and the Definition of ?Contact.? NCAA Bylaw 13.1 (Contacts and Evaluations)
indicates that ?recruiting contacts with a prospect (or the
prospect?s relatives or legal guardians) by institutional staff members and/or representatives of the institu-tion?s athletics interests are subject to the provisions set forth in this bylaw.? However, the term ?contact? is never defined within Division III legislation. The definition of contact, as used in Divisions I and II, was adopted in 1980. At that time, Division III institutions did not consider the proposal, since it was specific to Divisions I and II only. Revisions to the definition came in 1994 and were only considered by Divisions I and II. Since then, no comparable legisla-tion has been proposed for Division III institutions. Since it appears to be a mere oversight that this legislation was never considered in Division III, the committee agreed that Division III should adopt the same definition of contact that is currently used in Divisions I and II. The committee also recommended an editorial revision to Bylaw 13.1.1.2 to clarify the contact restrictions regarding four-year college prospects.

9. Review of Bylaw 13.12.2.1 (Preseason Practice and Competition). The committee reviewed the language in Bylaw 13.12.2.1 as it relates to Division III. This bylaw was adopted several years ago in all three divisions. However, the bylaw contains language that is not applicable in Division III. The recom-mended change is to delete the phrase ?provided such practice is not used to determine whether or not aid is to be awarded.? This is consistent with the commit-tee?s previous and ongoing efforts to delete language that is not applicable to Division III, thus creating a ?true? Division III manual.

?That the Management Council sponsor legislation to editorially revise Bylaw 13.12.2.1 (Preseason Practice and Competition).?
10. Review the use of ?With? and ?Against? in NCAA Bylaw 17. The committee did a preliminary review of the annual contest exemptions in Bylaw 17 to examine the words ?with? and ?against? as used to describe competition. The committee agreed to review this issue in depth on future conference calls.
11. Discussion of Possible Changes to Current
Legislative Cycle. The committee
continued its discussion regarding possible changes to the current legislative
cycle. In light of the present work of
the NCAA Presidents Council/Management Council Joint Subcommittee
on the Future of
Division III and the recent advances to LSDBi, the committee agreed to defer
any further discussion re-garding possible changes to the Division III
legislative cycle.
12. Committee
Operations Plan. The committee
reviewed and updated its operations plan.

The meeting was called to order at 8:10 a.m. All were present as previously indicated except for Daniel Dutcher.

Review and Consideration of Division I Proposals for
Possible Sponsorship in Division III. The committee reviewed five proposals
that were recently adopted in Division I.
No further action was taken.
14. Deregulation of Bylaw 12. The committee agreed to defer its review of Bylaw 12 until it receives recommendations from the Amateurism Task Force.
15. Deregulation of Bylaws 30 and 31. The committee reviewed additional changes to Bylaws 30 and 31 based on feedback from the championships staff.
16. Election of New Chair. Mr. Purnell was selected as chair-elect to succeed Ms. Coffey. Mr. Purnell?s term will begin at the close of the 2003 NCAA Convention.
17. Bylaw 13.1.1.2 (Four-Year College Prospects). The committee reviewed a request from the membership to consider legislating penalties for institutions that violate Bylaw 13.1.1.2. The committee agreed that the expressed concerns should most appropriately be addressed by a membership-sponsored legislative proposal.

April Approval of
Non-Convention Legislative Drafts. It has been past practice to incorporate
non-Convention legislation that is approved in legislative form during the
January Council
meetings into the manual the following August.
The committee was informed that technological advances may enable
non-Convention legislation that is approved in legislative form during the
April Council meetings to also be included in the manual the following
August. To the extent that technology
would permit, the committee supports including April drafts within the
following edition of the manual.
19. Incorporated Interpretations. The committee agreed to incorporate the following interpretations into the 2002-03 manual.
a. June 19, 2001. Division III Sports that Conclude with a National Collegiate Championship.
b. August 5, 2001. Dietary Supplements.
c. December 28, 2001. Final Semester/Quarter Exception -- Graduate Student.
20. Future Meetings for 2002-03 (In-person Meetings and Teleconferences. The committee agreed to meet on the following dates:
a. August 1, 2002, via teleconference 11 a.m. Eastern time.
b. September 4, 2002, via teleconference 2 p.m. Eastern time.
c. October 2, 2002, via teleconference 2 p.m. Eastern time.
d. November 6, 2002, via teleconference 2 p.m. Eastern time.
e. December 4, 2002, via teleconference 2 p.m. Eastern time.
f. January 30-31, 2003, site to be determined in Key West, Florida.
g. June 23-24, 2003, Indianapolis, Indiana.
21. Adjournment. The meeting adjourned at 1:45 pm.
