Teleconference      October 6, 2003

[Note:  These minutes contain only actions taken (formal votes or stated "sense of the meeting") in accordance with NCAA policy regarding minutes of all Association entities.  While certain items on the committee's agenda were acted on at various times throughout the teleconference meeting, all final actions within a given topic are combined in these minutes for convenience of reference.]

 

 

The telephone conference was called to order at 11 a.m. Central time. 

 

1.      Review of Previous Minutes.

 

It was VOTED

 

"That the September 3 teleconference minutes be approved."

 

 

2.      NCAA Division III Bylaw 14.5.4.1.1 -- Multiple Two-Year Colleges.  The committee reviewed Division III Bylaw 14.5.4.1.1 and considered whether a student-athlete may use part-time terms of attendance to satisfy the two-semester requirement in order to meet Division III transfer regulations.  The committee agreed that it was not the intent of the


   legislation to permit a student-athlete to use part-time terms in order to satisfy the transfer

         exception and that a student-athlete must attend the two-year college for at least two full-time semesters.

 

         It was VOTED

 

         “To remove the reference to part-time terms and require student-athletes to attend a two-year college for at least two full-time semesters in order to satisfy Division III transfer requirements.”

 

 

3.      Bylaw 12.5.1.1 -- Promotional Activities.  The committee reviewed Bylaws 12.5.1.1 and 12.5.1.9 and a request from the NCAA Division III Management Council to support noncontroversial legislation eliminating the requirement for a student-athlete to obtain athletics director approval for participation in NCAA championship promotional activities provided the activity meets all of the other provisions of Bylaw 12.5.1.1 and is subject to approval by the NCAA.

 

It was VOTED

 

   “That the Management Council sponsor noncontroversial legislation to permit the NCAA or member conference (or a host institution, host conference or local organizing committee acting in conjunction with and subject to approval from the NCAA) to use a student-athlete’s name or photograph in materials (e.g., handbills, flyers, booklets, brochures, signage, banners, advertisements) promoting NCAA championships or other NCAA events, activities or programs, without requiring written approval of the student-athlete or the student-athlete’s director of athletics.”

 

 

4.      Review of Division III Manual Proof.  The group agreed to adjust the review of the Division III Manual from the February 2004 meeting to the June meeting.

 

 

5.      Future Meetings and Teleconferences.

 

a.             November 3; via teleconference, noon.

 

b.            December 3; via teleconference, noon.

 

c.             February 5-6, 2004; site to be determined in New Orleans, Louisiana.
