REVISED ADDENDUM TO THE REPORT OF THE

NCAA DIVISION III MEMBERSHIP COMMITTEE

 

 

1.   ACTION ITEMS.

 

a.      Bylaw 3.6.1.2.1 (Provisional Membership – Fourth Year Progression).

 

(1)   Recommendation.  Adopt noncontroversial legislation to amend NCAA Bylaw 3.6.1.2.1 to create a waiver of the requirement that the third and fourth years of provisional membership be completed consecutively.

 

(2)     Rationale.  Bylaw 3.6.1.2.1 indicates that the third and fourth years of provisional membership must be completed consecutively.  The committee would like to create a waiver opportunity for this requirement.  This waiver would allow flexibility for situations that merely warrant a repeat of year four.  Such flexibility is not permissible under current legislation.  This recommendation is consistent with the committee’s belief that the provisional process should be educational rather than punitive.  It is also consistent with the Division III Management Council’s previous decision to allow institutions to move forward in cases of noncompliance with NCAA legislation if the committee determines the noncompliance to be minor.

 

(3)     Budget Impact.  None.

 

b.      Provisional Member Annual Reports – Final Year of Provisional Membership.

 

(1)   Recommendation.  That Becker College repeat year four of the provisional membership process.  [Note:  Unless legislation is adopted to amend Bylaw 3.6.1.2.1 as indicated above, this recommendation is not permitted under current legislation.  Should Management Council decide not to approve the committee’s proposed amendment to Bylaw 3.6.1.2.1, the committee recommends that Becker College be granted active membership status due to the minor nature of its noncompliance with NCAA legislation.]

 

(2)   Rationale.  Upon review of Becker College’s annual report, the committee agreed that Becker College should repeat year four of the provisional membership process.  Becker College was not in full compliance with all Division III legislation during the 2001-02 academic year due to a minor violation in the sport of men’s golf.  Due to miscalculation, the institution permitted a transfer student-athlete to compete during his eleventh semester of collegiate enrollment.  The committee agreed that the violation did not warrant a repeat of two years of provisional membership.

 

(3)   Budget Impact.  None.

 

 

c.       Provisional Member Annual Reports – Final Year of Provisional Membership.

 

(1)   Recommendation.  That Huntingdon College be moved into its fourth year of provisional membership.

 

(2)   Rationale.  On its review of Huntingdon College’s annual report, the committee agreed that the institution should be moved forward.

 

(3)   Budget Impact.  None.

 

 

d.       Bylaw 20.6.2.5 (Reclassification of Provisional Membership from Division II to Division III).

 

(1)   Recommendation.  That Texas Lutheran University be moved into its fourth year of provisional membership.  [CORRECTION:  At its July meeting, the Management Council did not consider this recommendation to move Texas Lutheran forward one year in the three-year reclassification process.  The Presidents Council will take action at its next meeting to grant active membership status, effective September 1, 2002, to Texas Lutheran.]

 

(2)   Rationale.  On its review of the reclassifying member's annual report, the committee agreed that the institution should be moved into the fourth year of provisional membership.

 

(3)   Budget Impact.  None.
