INTERPRETATIONS AND LEGISLATION COMMITTEE
ACTION ITEMS.
a. Noncontroversial Legislation ? NCAA Bylaw 12.5.1.9 ?
Promotion of NCAA and Conference Championships.
(1) Recommendation. Sponsor noncontroversial
legislation to permit the NCAA (or a host institution, host conference or local
organizing committee acting in conjunction with and subject to approval from
the NCAA) to use a student-athlete's name or photograph in materials (e.g.,
handbill, flyers, booklets, brochures, signage, banners, advertisements)
promoting NCAA championships or other NCAA events (e.g., conference events)
activities or programs without requiring written approval of the
student-athlete or the student-athlete's director of athletics.
(2) Rationale. The committee reviewed NCAA Bylaws 12.5.1.9 and 12.5.1.1 and determined that allowing NCAA national office staff, a host institution, host conference or local organizing committee to use the name or photograph of a student-athlete in promotional materials will ease the administrative burden of hosting a championships and allow promotions staffs more flexibility in the types of promotions used for championship events. The committee noted that these materials are currently permitted; the only change is the elimination of the required director of athletics signature.
(3) Budget Impact. None.
b. Modification
Based on Intent ? Bylaw 14.5.4.1.1 ? Multiple Two-Year Colleges.
(1) Recommendation. Modify Bylaw 14.5.4.1.1 to indicate that a
student-athlete may combine terms of part-time (as opposed to part time and
full time) attendance at any f the two-year colleges to satisfy the minimum two
semester or three quarter attendance requirement.
(2) Rationale. The committee reviewed Bylaw 14.5.4.1.1 and

c. Modification
Based on Intent ? NCAA Bylaw 14.2.5 ? Hardship Waiver.
(1) Recommendation. Modify NCAA Bylaw 14.2.5 to require
contemporaneous medical documentation to be approved by a physician (e.g.,
medical doctor).
(2) Rationale. The committee reviewed Bylaws 14.2.5 and 14.2.5.2.2 and the requirement of contemporaneous medical documentation. The committee considered whether such documentation must come from a physician or whether statements from nonmedical counselors are acceptable. The committee agreed that the validity of the medical documentation is dependent on it being provided by a qualified source. While the committee agreed that documentation from nonmedical counselor is helpful, ultimately, any diagnosis should be reviewed with a qualified medical professional.
(3) Budget Impact. None.
d. Interpretation of Division III Institution that Conducts a Sport Classified in Division I Providing Athletically Related Financial Aid.
(1) Recommendation. Approve the following interpretation:
"Division
III institution that conducts a sport classified in Division I providing
athletically related financial aid: A
Division III institution that conducts a sport classified in Division I and
meets the criteria for a waiver per NCAA Bylaw 20.7.1.1.1 (waivers) may not
provide athletically related financial aid to a student-athlete in that sport
if the student-athlete participated in another sport at that institution during
the same academic year.

(2) Rationale. The committee reviewed a staff interpretation related to Division III institutions conducting a sport in Division I and the provision of athletically related financial aid. The committee considered this issue to be of national significance; thus the interpretation should apply to all institutions.
