NCAA DIVISION III MANAGEMENT COUNCIL

PERMISSION TO CONTACT SELF-RELEASE SUBCOMMITTEE

 

 

1.      ACTION ITEMS.

 

a.      Modification Based on Intent – 2004 NCAA Convention Proposal No. 59.

 

(1)     Recommendation.  Sponsor a modification of wording of 2004 NCAA Convention Proposal No. 59 to require that institutions in receipt of a student-athlete's permission to contact self-release form shall not contact the student-athlete's current institution until the 30 day effective period of the self-release expires, unless the student-athlete grants the institution permission to make that contact.  Further, if the student-athlete intends to pursue the transfer after the 30 day permission to contact period, to require that the receiving institution notify the student-athlete's current institution within one week of the expiration date of the form that a self-release has been issued.

 

(2)     Rationale.  In order to provide the student-athlete with privacy in the transfer contact process, institutions should not contact the student-athlete's current institution for academic or other information until sufficient time has elapsed for contact to occur between the student-athlete and the institution of interest.  The student-athlete's current institution should be alerted in a reasonable timeframe that the student-athlete intends to transfer.  Thus, no later than within one week of the expiration date of the permission to contact, if the student still expresses an interest in transferring, the receiving institution must disclose, in writing, to the first institution's athletics director that a self-release for that student-athlete has been submitted.

 

(3)     Budget Impact.  None.

 

b.      NCAA Form for Permission to Contact Self-Release.

 

(1)         Recommendation.  Approve the appropriate NCAA form for student-athletes to grant institutions permission to contact the student-athlete.  Attachment A would implement the legislation as it was adopted at the 2004 Convention.  Attachment B also would incorporate the additional 30-day privacy concept proposed in action item "a."

 

(2)         Rationale.  The subcommittee determined the form should include the name of the institution being granted the permission to contact the student-athlete, basic information about the student-athlete, and a description of transfer regulations and the process to issue the self release.  The form also describes the 30 day effective period for the self-release.


(3)         Budget Impact.  None.

 

 

2.      INFORMATIONAL ITEMS.

           

·              Communications Plan.  Information about the permission to contact self-release has been added to the student-athlete statement.  The subcommittee has requested the NCAA Division III Student-Athlete Advisory Committee (SAAC) identify additional vehicles to alert student-athletes of the opportunity to grant permission to contact.  Staff will review the SAAC recommendations.
