Presidents Council Grouping – Proposal Nos. 1-6.
General Notes – The
Presidents Council (PC) has identified six proposals of particular interest to
Division III chief executive officers (CEOs). Thus, these proposals are included in
the PC grouping. Each proposal will
be considered by roll-call vote.
All motions and votes related to these proposals also must be considered
by roll call.

The Presidents Council intends
to withdraw this proposal on the Convention floor and use that opportunity to
describe why the proposal is being withdrawn. A position paper has been drafted to this
end. |

The NCAA Division III
Interpretations and Legislation Committee has recommended a modification of
wording to permit practice for
the NCGA event to be exempt from the 19-week playing season, and to clarify
in the intent statement of this proposal that the NCGA national championships
is a women's only event. The
script for the Business Session will reflect this point. |

This proposal amends language
that has been updated since the printing of the 2004-05 NCAA Division III
Manual. As such, the current
language shown in the 2004 NCAA Official Notice does not match the hard copy
of the Manual, but rather, reflects the update language that exists in the
legislative services database (this is standard policy). The script for the Business Session
will reflect this point. |

There may be a motion on the Convention floor to divide golf and tennis. This would be properly accomplished via a "motion to divide." The mover must clearly state how the division is to be made. The motion is not debatable and requires a simple majority vote to pass. The motion may be amended, with the amendment suggesting a different way to divide the original motion; however, this does not seem likely in this case. Also, questions have arisen
regarding the implementation of the proposal within the championship
structure. This proposal involves
only the establishment of automatic qualification access in the sports of
golf and tennis. The timing of
those championships, while a related issue, is outside the scope of the
proposal. The NCAA Division III Championships
Committee, however, will review recent survey results and make a
recommendation to the governance structure regarding timing prior to the |

While not clearly stated in the
proposal, the intent of the NCAA Committee on Competitive Safeguards and
Medical Aspects of Sport was that this proposal should only apply to those
substances banned by the NCAA.

2005 NCAA Division III Business Session
This appendix contains five official interpretations
incorporated into the Division III Manual on the recommendation of the
Interpretations and Legislation Committee.
The delegates’ acceptance of the 2005 Official Notice constitutes
approval of these proposals for inclusion in the 2005-06 Division III
Manual. If a delegate objects to a
particular proposal, that objection should be raised during the beginning of
the 2005 Division III Business Session prior to the adoption of the Official
Notice. That proposal would then be
considered separately by the delegates, with a majority vote needed for
adoption. Proposals not adopted are
referred back to the committee for further consideration.
This appendix contains 42 noncontroversial proposals
adopted in 2004 by the Division III Management and Presidents Councils. The Councils have authority to adopt
such legislation, provided it is noncontroversial and necessary in the orderly
administration of the Association’s legislation. The delegates’ acceptance of the
2005 Official Notice constitutes approval of these proposals for inclusion in
the 2005-06 Division III Manual. If
a delegate objects to a particular proposal, that objection should be raised
during the beginning of the 2005 Division III Business Session prior to the
adoption of the Official Notice.
