NCAA DIVISION III MANAGEMENT COUNCIL

ADMINISTRATIVE REVIEW SUBCOMMITTEE

 

 

INFORMATIONAL ITEM.

 

·                    Summary of Cases.  From February 1 through May 31, 2006, the NCAA Division III Management Council Administrative Review Subcommittee and/or the NCAA membership services staff reviewed a total of 20 cases. [Attachment]  The following is a summary of the decisions made by the staff and the subcommittee:

 

1.                  Staff granted 10 cases.  Of the 10 cases staff granted, eight cases were granted based on the totality of the circumstances and/or student-athlete well being and two were granted based on case precedent and/or the Management Council’s directive.  The subcommittee approved all of the staff’s decisions.

 

2.                  Staff denied 10 cases.  Of the 10 cases staff denied, all were based on case precedent, intent of the legislation, competitive advantage gained by the institution, circumstances within the control of the student-athlete or institution and/or circumstances did not warrant a waiver of the legislation.  Nine of the 10 cases were not appealed to the subcommittee.

 

3.                  One case was appealed to the subcommittee.  The subcommittee affirmed the staff denial.
