PRESIDENTS COUNCIL ACTION ITEM

 

ISSUE:

Sanctions for Second Positive Drug Tests ? NCAA Bylaw 18.4.1.5.1.

Committee Recommendation:

 

Sponsor legislation for the 2004 Convention to amend NCAA Bylaw 18.4.1.5.1 to state that testing positive twice for anything other than street drugs will result in the loss of lifetime eligibility, while a combination of two positive tests involving a street drug, in whatever order, will result in the loss of an additional year of eligibility. Further, that counseling be encouraged in addition to the loss of a year of eligibility for a positive street drug test, effective August 2003.

 

Management Council Action:

 

Sponsor legislation for 2004. Recommend committee also consider more stringent penalties to include a lifetime ban for any two positive drug tests.

Approved sponsorship of legislation for 2004 Convention.

1. ISSUE:

Student-Athlete HIPAA Authorization/Buckley Amendment Consent for Disclosure of Protected Health Information.

Committee Recommendation:

 

Amend Bylaw 30 Administrative Policies to include the Student-Athlete HIPAA Authorization/Buckley Amendment Consent For Disclosure of Protected Health Information form (Attachment A) and require annual distribution to each student-athlete, along with the NCAA compliance forms, effective August 2003.

2. ISSUE:

Banned Drug List and Nutritional Supplement Warning to Prospective Student-Athletes.

Committee Recommendation:

 

Identify a process for Division III to ensure that all member institutions provide information about the NCAA banned drug list and the risks of nutritional supplement use to all incoming student-athletes by July 1 each year and to all other prospects when the institution initiates the recruiting process, effective June 1, 2003.

 

Management Council Action:

 

Supported the process of notification of NCAA banned drug information specifically for year-round drug testing in Divisions I and II. Division III will encourage institutions to distribute information as soon as possible to all identified recruited prospects.

3. ISSUE:

NCAA Drug Testing Results January ? June 2002.

Committee Recommendation:

 

Approve the results of the NCAA drug-testing program for the period from January to June 2002.

4. ISSUE:

Revisions to the Drug-Testing Consent Form.

Committee Recommendation:

 

Add language to the drug-testing consent form that gives permission of the student-athlete to the NCAA to use drug-testing samples in drug-testing research, provided the sample?s identity remains anonymous, effective August 2003.

5. ISSUE:

Extension Request for the Committee Chair and the NCAA Drug-Education and Drug-Testing (DEDT) Subcommittee Chair.

Committee Recommendation:

 

Extend for two years the appointment of the DEDT Subcommittee (Division III) representative (2003-05).

6. ISSUE:

Creation of a Division III Football Preseason Practice Model.

Committee Recommendation:

 

Develop a football preseason practice model that incorporates the general acclimatization, medical resource and recovery criteria contained in the Committee on Competitive Safeguards and Medical Aspects of Sports July 2002 Management Council report and is consistent with the health and safety aspects of the proposed Division I and Division II football preseason practice models. Basic components should include:

 

(a) Medical examinations or evaluation of all student-athletes prior to any preseason practice activities;

 

(b) Initial five-day single practice acclimatization process to environment, exercise and equipment for all football participants; and

 

(c) No consecutive multiple-day practices following the five-day acclimatization period.

 

Management Council Action:

 

Referred the recommendation to the Playing and Practice Seasons Subcommittee. The Council also recommended referral, when appropriate, to the Football Committee and the Football Coaches Association for input. The Council noted that the feedback should be forwarded for its April 2003 meeting and should include:

 

?         Impact on the length of preseason.

?         Impact on competitive schedule.

?         Out-of-season models.

?         Review should include Divisions I and II.

 

Presidents Council Action:

 

Endorsed the action of the Management Council, noting its support for an evaluation process consistent for Division III. The Council also noted the potential impact on preseason practice and the competitive season.

 

 

ITEMS OF INFORMATION

 

1. ISSUE:

Wrestling Weight Certification.

Committee?s Action:

 

The committee recommended the addition of air displacement plethysmography (ADP) technology (e.g. BOD POD) as an option to assess male body composition in the NCAA Wrestling Weight Certification Program, starting September 2003, after confirming the technique met the established committee criteria for an acceptable body composition measurement.

2. ISSUE:

Pole Vault Safety.

Committee Action:

 

The committee reviewed and supported recent rules changes by the NCAA Track and Field Committee regarding pole vault safety and identified a liaison to work with the NCAA Track and Field Committee on future discussions on this topic.

3. ISSUE:

Fan Violence and Crowd Control.

Committee Action:

 

The committee approved the submission of a statement to request actions be initiated through the NCAA national office to reduce negative behavior associated with intercollegiate contests. The statement is as follows:

 

The Committee on Competitive Safeguards and Medical Aspects of Sports (CSMAS) has noted with growing concern the escalating level of violence and property damage by fans and others that are occurring within sports venues and the surrounding communities in conjunction with collegiate competitions, especially those that arouse strong feelings on campus and in the adjacent communities. CSMAS requests that NCAA leadership focus constructive energies in identifying appropriate ways the NCAA can act, on its own behalf and in collaboration with other concerned collegiate organizations, toward reducing negative behaviors associated with intercollegiate athletics.

4. ISSUE:

NCAA Risk Management and Insurance Task Force.

Committee Action:

 

The Risk Management and Insurance Task Force requested comment from the committee on the task force report. The committee supports in concept efforts to expand medical care for student-athletes. The committee has identified in Guideline 1a of the NCAA Sports Medicine Handbook that ?each student-athlete should be covered by individual, parental or institutional medical insurance to defray the costs of significant injury or illness? (revised August 2000). During its June 2001 meeting, the committee voted to support the deregulation of Bylaw 16.4, and include language that reads, ?It is permissible for an institution to provide medical and dental expenses that the institution at its discretion determines to be incidental to an enrolled student-athlete?s participation in intercollegiate athletics including but not limited to, the following:? and identified insurance, counseling expenses, disability expenses, corrective eyewear and dental care.

5. ISSUE:

Championship Hosting Form.

Committee?s Action:

 

The committee supports adding a specific budget line on the proposed championship budget/financial form to include the cost of medical care and coverage. The cost to provide medical care and coverage during a championship is a real cost that must be reflected in these bids. Due to new requirements in athletic-training curriculum programs, many programs no longer have access to student trainers. The need to supplement staff to support a championship event is likely, especially when host teams practice simultaneously with the NCAA championship.
