legislation to permit the NCAA (or a host institution, host conference or local
organizing committee acting in conjunction with and subject to approval from
the NCAA) to use a student-athlete's name or photograph in materials (e.g.,
handbill, flyers, booklets, brochures, signage, banners, advertisements)
promoting NCAA championships or other NCAA events (e.g., conference events)
activities or programs without requiring written approval of the
student-athlete or the student-athlete's director of athletics. |

Modify Bylaw 14.5.4.1.1 to indicate that a student-athlete may combine terms of full-time (as opposed to part time and full time) attendance at any two-year colleges to satisfy the minimum two semester or three quarter attendance requirement. |

3. ISSUE: |
Modification Based on
Intent – Bylaw 14.2.5 – Hardship Waiver. |

Committee Recommendation: |

Modify Bylaw
14.2.5 to require contemporaneous medical documentation to be approved by a
physician (e.g., medical doctor).
The committee reviewed Bylaws 14.2.5 and 14.2.5.2.2 and the
requirement of contemporaneous medical documentation. The committee considered whether such
documentation must come from a physician or whether statements from
nonmedical counselors are acceptable.
The committee agreed that the validity of the medical documentation is
dependent on it being provided by a qualified source. While the committee agreed that
documentation from nonmedical counselor is helpful, ultimately, any diagnosis
should be reviewed with a qualified medical professional. |

4. ISSUE: |
Interpretation of
Division III Institution that Conducts a Sport Classified in Division I
Providing Athletically Related Financial Aid. |

Committee Recommendation: |

Approve the following interpretation: "Division
III institution that conducts a sport classified in Division I providing
athletically related financial aid:
A Division III institution that conducts a sport classified in
Division I and meets the criteria for a waiver per NCAA Bylaw 20.7.1.1.1
(waivers) may not provide athletically related financial aid to a student-athlete
in that sport if the student-athlete participated in another sport at that
institution during the same academic year. [References: Bylaws 20.7.1.1 (Division III
application) and 20.7.1.1.1 (waivers)]" |

Approved the official interpretation, including additional language that: "if a student-athlete receives aid in an academic year to participate in a Division I sport, he or she will be precluded from participating in any Division III sport during that same year." The Council recommended that the incorporation be included in the Division III Manual. |
